CGT Primary Residence Rules

I am UK resident but non dom. My husband and I live in rented accommodation and own no property in the UK.

Last year I purchased a house in Malaysia with a view to spending time in it as I own a small business there. Now the non dom rules have changed I am liable for CGT on my house (or pay the £30,000 non dom tax when I sell it).

Can I claim deemed primary residence for my Malaysian house as it's my only property? If not, for how long do I need to live there to claim primary residence?

    In order to qualify for only or main residence exemption, you have to actually occupy the property. There is no time for a property to be considered as a main residence, it is the quality of the occupation which is relevent. HMRC would look for evidence that all your personal and official correspondence goes to the address, that you are registered to vote there, pay local taxes and utitilies, etc, etc.

  • You have to actually have lived there to claim PPR im affraid.
    It also comes down to the quality of the residence rather than a period as the test used by HMRC.

    As above just im lazy.
