Can someone help me plz

Options
I received a default notice yesterday from Barclaycard! With credit solutions, I phoned them in sheer panic not understanding what a default notice is, I spoke to a woman who told me I must pay £100 now and £152 per month for 6 months. I stupidly gave my card details thinking I have no options. There is no way on earth I can pay that much, I phoned them back today, They passed me over to the same woman who was rather offended and said I as not pressured into giving money I was told now there is nothing I can do about, they are having the monthly payments, and im left in deep poo, with losing my job on almost living sweet nothing with a kiddie. Is there anything I can do to reduce the payment is what I want to know as they will not help me at the company. Sorry its such a long one, but im desperate ,Thanks

Firstly, was this a credit cards or a debit card?

You need to get a new bank account if it is a debit card and to talk to the existing bank about how you can cancel the debit payments. Plus write to the complaints department about the woman. She may say she did not pressure you but, but since you did not understand the legal situation, she is not entitled to take advantage of that. Nor is she allowed to take more than you can afford, but hs eis probably being paid commision on how much she gets out of you. Quote the Office of Fair Trading Guide-lines for Debt collection on both those counts.

it sounds like you also need some more general advice, so read here http://www.moneysavingexpert.com/loans/debt-help-plan#help and contact one of the debt charities for advice ASAP.

You have come to the right place for advice . We always advise NEVER PHONE these people . But its done now , we will move on . Please confirm if the card payments cancelled , even if it means cancelling that card . Can you ring your bank ?
  • Hi, the debt was a barclaycard debt, I gave my debit card current account number out for direct debit, They are so frustrating they will not help me at all, I ask to talk to someone else but they keep putting her back on the phone to me , Thank you for you're advice, I will keep you posted on how i get on
  • Im on it, What do I do when the direct debt is stopped! should I call or write, I am worried, in the letter they talked about doorstep collection!

Door step collectors have the same powers as the paper boy - none. Do not worry.

You earlier said you can not afford the payment so if the direct payments were taken that would mean a bank charge for a returned DD payment . You MUST give yourself time to read other threads so you understand what you can do . In this situation you must take control . The reason i said cancel your card was they could try and take a payment before a direct debit is set up .

    Dear Sir/Madam

    Account Ref

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully

    That should squash that threat

Would just like to thank you for all advice yesterday, I spent the day reading through this site and been to OFT site also, I realised In need help with this one, as this is all new to me, and I'm really pants at fighting my corner, so I have been in contact with the National debt line and they have give loads of advice, and hopefully put a stop to the bully tactics of the credit company and I realise they cannot get a way with half of the things they threat.. I'm so glad I posted on here, And lesson well and truly learnt! never try to deal with these people over the phone.
Slept like a baby last night for the first time in ages :)
