Title Deeds Query

Mortgage taken out with husband in joint name with NR in 2003. Now divorced and have solicitors document saying he no longer has anything to do with house or mortgage. NR won't take his name off mortgage as they say my income isn't enough. Can't afford to pay the insurance to put my new husband on the deeds because of long term health problems. Want to sell up but NR say they want £1000 to take ex's name off, they will add this to mortgage. Any advice please

    Either you or your new hubby needs to buy your ex out of the mortgage.

  • They wont take his name off the mortgage because if you default, they will have recourse to him. Typical Banking stance!

    Selling the property and repaying the mortgage is the only way they will relinquish their charge over the property - normally they would allow you to substitute another partner but that person must meet their minimum requirements and thats clearly not the case here.

    Its possible that the sale of the property can be effected without having to involve your ex-husband especially if the Title of the property is no longer in his name. He'll still receive a redemption statement I imagine.

    Approach the solicitors that dealt with your side of the divorce and speak to their conveyancing arm (if they have one). They will be aware of the background and it should be easier.
