Can anyone offer advice on this one please?
My husband took out a car loan around year late 1990's, this was way before we got together.
He has never been very good with money so he is not sure of the details but he thinks it was for around £2000. We had a letter two years ago from a debt collection agency for the £2000 with interest which was now nearly £10000. He believes he had paid it all off but the company that arranged the finance said he hadn't. We asked for a statement to prove this and never received any contact again until we received a letter from a solicitors to say that they were taking the matter to court. It was taken to court within weeks at a court 300 miles away so we were unable to attend and now they have a court action to say that in the event of a sale of the house they take my husband half of the equity out of our house should we not pay and that failure to pay will result in further court action to MAKE us sell the house to get the equity. We have agreed £25 per month which in other words means it will never get settled and the interest accrues every year. The dca will not speak to us directly we can only communicate through the solicitors and we have several times asked for a statement of account so we can see the exact breakdown of the loan, interest, payments we have made etc but as yet received nothing.
We have just received another letter from a different collection agency for the same debt demanding payment. My husband wont talk to them as he says it has been dealt with and they wont speak to me without his say so so I just wanted to know if anyone else had a similar experience. Should we seek our own legal advice and try and get this charge reversed or what?
I fear if we dont sort this out the other company could take us to court and we could be forced to sell our home.

Hi
lost the previous post.
First thing.
This debt is almost certainly statute barred, if there awas a gap of 6 years between when you OH stopped paying back in the 1990s and the date when you made the deal to pay £25 per month.
Please cna you check this out.
If there was, then you need to stop paying and send a statute barred letter to the Dca to whom you ar epaying and the mob who have jsut written to you.
Until you do that the DCa are entitled to ask you to pay.If you've have not made a mistake, you've made nothing0 -
Can you please give the following a ring
