credit card debt

i owe £7k on a lloyds tsb credit card and cant afford anymore than i have offerd in repayments,they are taking me to court soon,can they take the house or send in bailiffs,i have already shown to them via the cab,that i cannot pay anr more

    Please do not panic , its important, a court will not take your home away from you , a credit card debt is an unsercured debt . You are paying what you can afford , a court would take that into account. IF a Jugdement was gained , a court will not order you to pay more than you can reasonably afford . Please post further details , help is available !
  • god bless for that,my wife is severely depressed by it all,we have told the bank and supplied them with concise details of what we are spending and what we can pay,we have also offered25% of the amount with a possibility of a fraction more but they didnt even reply to that one,it iss lloyds tsb and a bank we used to bank with but obviously not now,we have filled the n9 in with the help of the cab and she has stated exactly what we offered them and the absolute limit of what we can afford,can they send bailiffs in> please let me know

    Hi Dave Drum

    First of all please don’t worry. Once an affordable payment amount has been set on the CCJ all you have to do is keep paying it each month as agreed. As long as you are doing this bailiffs cannot be sent, this would only happen if you missed payments or ignored the paperwork but you have replied as the court requested, so as long as you pay your ok.

    How long have to had the CREDIT CARD ? Is it in hands of a DCA ? This imformation is important before you submit papers to court .

    There are a number of things you could do . You can ask the bank to supply a true signed copy of the Consumer Credit Agreement .If they do not produce this, the debt could be unenforceable . You can have the case moved to a local court which will help . In the papers you have to return to court , there a section for entering a defence . You do not have to denie or amit the debt at this stage . You can wait until a CCA is supplied .
    Many CCJ are issued because they are not defended ! You should look on other threads there are links to courrt procedures . I,m sure someone will post up some very good guides shortly .
