buying car - contract question

Today me and the wife went looking for a "new" 2nd hand car, and agreed a sale with a main dealership.:beer:

We paid £100 deposit. Having got home, we have seen the same vehicle on a newer reg, with fewer miles, at a different dealer. I know, we should have done more research first.:mad: :o

From reading the small print on our contract, it looks like if we cancel, we lose our deposit of £100, but nothing else.

Does anyone have experience of this situation, or any advice ?

If it is only the £100 we stand to lose, then the newer, better, less mileage car will be the one we go for.

    If I was the dealer then if I could not sell the first car that you saw for the same price that you agreed to then I would consider suing you for loss of profit/bargain.

    Talk to the garage and see how the land lies before updating us here.

    Why ?? Op has entered into a contract to buy the vehicle.
    If he cannot get the same price for the vehicle if OP pulls out then in contract law he can be sued for the difference.

    All the garage has to show is that it has minimised its loss.

    Any contract law book will tell you this.

    He won't get sued. just lose the £100 deposit.

    OK, a quick update, and thank you all for opinions and advice.
    Having done some law at uni many years ago, I was worried about contract law. However, the wonderful sales guys at Citroen Bradford have been very understanding, and it will only be the deposit that we lose......unless they plan to ambush me with court action later.:eek:

    We have managed to get a car that is 18 months newer :beer: (04 instead of 52) and with less miles :beer: (29,000 instead of 59,000) and a higher spec :j(desire instead of sx), for a lower price :j (£4495 instead of approx. £4800) and with more trade in for our car :beer:(£2300 instead of £2100).

    So that makes us approx. £400 better off, with a newer, better, lower mileage car.:T

    Moral is ALWAYS research before setting out to look.
