    If the employer is in breach of contract as you are arguing, a court would look to put you back in the position as if the contract had been carried out. Therefore you would be entitled to one weeks pay (taxed). Makes the current offer look quite attractive.

    Is your payroll manager a qual accountant? Very few are, and if he is, then he can't be that good if he is only in that role. No offence to accountants who are payroll managers, but it is a job that can be done with few qualifications.

    Brightonman123 – I don’t want to just take the money and get taxed. I’m into tax avoidance as much as possible. I once persuaded my employer to increase my budget for a weeks stay in a posh hotel by getting them to pay the bill and recover the VAT and by taking two days unpaid leave so that they saved my full salary but I only lost the value after tax and NI. Once they paid my travel I came out even.

    Oddly enough I am an Accountant, just don't do PAYE! Plus I don't think this is a PAYE issue.

    I don't get this. Excuse me saying this but you don't sound like any accountant I've met. I certainly don't know any accountants who misquote breach of contract as breech (as in childbirth).

    personally id take the money you have not actually worked for it ,id be more concerned as to why the offer was withdrawn.
