Hi Everyone Im new to this and not sure Im getting this right yet??

Its so nice that theres lots of people in the same boat, and that we can halp each other,,,, Ive set up a plan with Payplan all going quite well although like someone similar emails seem better as communication can sometimes be a bit sketchy?? I have two remaining creditors my Bank NWBS for my OD and CC who have refused my offer and have sold so nice Agents (not) who are now progressing through the courts..:mad:


Im really fed up with them, Ive been with them for 20 years and they have treated me appallingly, talk about make it hard as possible, I have continued to pay them throughout I prob owe them around 7K but they keep bumping the charges on which is criminal..:mad: .

Can anyone advice, would I be able to progress them down the Bank Charge reclaim?? They have prob charged me over the last 6 years a substantial amount which would pay them off???

    Hi there, there is a thread for people with CCCS and payplan who are on a DMP..But i have forgotten the name of the thread but someone should be along in a mo and they will let you know as i think thats where you would be best asking your questions

    I'm not clear on two points:

    1. NWBS - is that Nat West? Banks are always slow to agree to offers on a dmp but they usually do so in the end.

    2. Their agents (who are they?) are taking court action? Is this just the usual threats or have you had a court claim form. If so, how did you respond?

    This is what I recommend

    Those creditors you’re having difficulty with, contact them and obtain the name and fax number of a supervisor / manager, no one lower.

    Then contact DMP manager, ask them to fax over your I&E, together with your “Letter of Authority” to act.

    Then write to the CEO of each creditor you’re having difficulty with, enclosing the details below, informing him / her they are in breach of the OFT guidelines, which clearly state:

    Deceptive and / Or Unfair Methods.

    2.8 Examples of unfair practices as follows:

    C: Refusing to deal with appointed or authorised appointed third parties, such as, Citizens Advice Bureau, Independent Advice Centres, or Money Advisors.

    On the top of your letter state very clearly in bold letters “FORMAL COMPLAINT

    Give the name of the organisation and account number of whose managing your DMP, this is your authorised third party appointed representative.

    Inform them if they fail to respond to your complaint within 7 working days, you reserve the right to take your complaint to the OFT for adjudication.

    Sit back and see what happens.

    Send your letter by RECORDED DELIVERY.
