Bankcrupcy in Scotland

Hi,
I have known for about the past year and a half that I need to declare bankcrupcy, I owe about £20,000 and I am a single mum I work for 32.5 hours a week, but that get spent on nursery fees e.t.c
i can declare bankcrupcy with the new low income / assests rule, so I need to apply for that as soon as I get paid so I can pay the £100 fee. but I have received today a notice of earning arrestment for council tax so they are going to take just over a hundred pounds from my pay, making me super douper skint next month.
I was told that when I got an arrestment for earnings, I should be able to declare bancrupcy within 10 days, but I got nothng from the court with this letter, so I dont know how to??
Also I have a claim for bank charges outstanding. I am due RBS about £10,000 £3,000 on my bank account, £4,000 for a loan and the rest on interest for the loan, I got contacted by RBS debt collection people saying if I pay them £3,000 they will write off the debt, then got offered £4,000 charges refund, but they wont accept the refund as the payment for the debt, so I havent settled. the case is still on hold.
What happens after the year of bankcrupcy to the bank charges, can i still get the refund? The only reason I got into so much trouble in the first place is becuase my ex hubby left, my income halfed, by dad died, I spent time down in my home time to get things orgnaized with my disabled mother, I missed payment on the RBS loan e.t.c and they charged me and charged me until I had no money to live on and opened a different bank account (a step account since RBS made my credit score so bad I cant even open a bank account).

Thanks Op for starting this discussion. Long story but I was medically incapacitated from my career in June 2001 & have only worked for x1 week for one employer & around 4 months for the second one. I have not paide anything to any of my creditors for over 4yrs and my debts just get kicked around the collection agencies. Get the occasional letter, that is all. I'd love one of them to take me to court so I can plead bankruptcy due to being unable to save the £100 d.i.y. fee with the credit union. At least I do have one of the basic/primitive:D bank accouunts with electron so I can order online or use chip&pin in stores. Really, it looks like you need money to go bankrupt lol. Is it me who is twisted???0

I know what you mean the whole world is totally nutts, until I got this letter for council tax I didnt know about the change in law so I have been waiting the past yeah and a half / two years to declare bankcrupcy and it all seems wrong! you have to pay to go bankcrupt?! and in Scotland till this change you cant declare your self bankcrupt you have to wait for 10 years until someone decides to take you to court!
There are so many mis informed people going around aswell. I keep being told that you cant have a bank account when you bankcrupt, did every body miss the fact that the govement decided people have to have access to bank accounts which is why Natwest for example as that is who I with do a step account, which you can use through bankcrupcy! the whole world has gone mad!Bankruptcy Supporters Club No.1790 -

OP ...you mention "misinformed people going around"....on top of that be cautious of any info you see on the web also concerning scottish sequestration as so much of the advice is still aimed at the laws pre april 2008, to be honest i only draw info from the AIB website (unfortunately last time i checked one of the dent charity sites four days ago the advice was still outdated.
The system has been massively improved but as far as clarity is concerned its got a long way to go
