Reclaiming Mortgage arrangement fees???

With yesterday's ruling in mind, is there any chance that in the near future we will be able to claim back mortgage arrangement fees.
I already have my mortgage with HSBC and have just agreed to another 2 year fixed rate deal with them on their rate matcher offer - so effectively they are matching the last fixed rate that they offered me of 4.79%.
Only problem is they are charging me £1699 for the pleasure. It's the same company, same mortgage that I am having - surely the real cost of arranging the new fixed rate can't be anywhere near this amount?
Do you think this ruling will mean that the banks are unable to charge such large fees in the future?
