What Do I Do?

Hi, I am very soon to go BR, however I have a question. I phoned the CCCS and explained that I have applied for a Nationwide bank A/C a few weeks ago. I have not heard back from them yet. Now I am about to go BR early next week..if I still have not heard from the Nationwide and I am declared BR, do I need to inform the OR if the accecpt me AFTER? The chap at CCCS said I must tell them about the bank A/C, otherwise it would be contempt of court. Is this correct?
I am really not sure what to do.
Has anyone had a similar experience, or can someone give me any advice. I will have a fair bit of cash in the A/C that I have applied for, which would help me during the BR.
Thanks,
Nomunny.

Hi Nomunny
Welcome to the site. I hope all goes well next week & that you are managing to keep the nerves under control.
I would call the Nationwide & chase up...or go into the Branch. There could be a problem with the identification so you would need to go in anyway. Don`t wait for them to call you....if they have declined the account (or gone to appeal) it is likely to cause delay. Either way you need to know in order to advise the OR.
If it is declined call the Coop or Barclays. Waiting a few weeks to open a basic account is unacceptable. A couple of days max is the norm.

Definitely check with Nationwide to see what is happening.
If the account is in the process of being opened when you go BR then you really should declare it.
Also be aware that Nationwide now do not appear to offer accounts to undischarged bankrupts. So when Nationwide find out about the bankruptcy (and they will) it is a little uncertain whether they will allow you to keep it.
Several people here who have have the basic Nationwide account for some time before their bankruptcy have been allowed to keep them, but since you are just opening yours I would say it is more likely than not that they would want to close it. Can't say that 100% for certain though.
So if I was you I would start looking at the Co-op Cashminder or the Barclays Cash Card accounts just in case.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks for your replies...Barclays is out as I already have an A/C with them currently! I thought I would come clean and actually explained to the manager at Nationwide I was about to go BR and he seemed cool about it, however that was two weeks ago and not heard since...so I will chase. I have opened the A/C with a bit of money (sold premium bonds)...will the OR take that? I really need it to help me through.
I have already had a solicitors letter from one of my credit cards, threatening if I don't pay in 7 days time court proceedings may be instigated against me blah blah...what should I do about it?
I'm really getting nervous about the whole thing now!
Thanks,

I used to be a bankruptcy clerk in a county court.
If you have any savings then you have to declare them to the OR otherwise you can get into a lot of trouble. I know you say you need the money to get through (and believe me I sympathise!) but because you are going bankrupt it is up to the OR to decide how much money you need to live on. Depending on how much your premium bonds sold for, the OR might let you keep it but it's more likely that the money will be used to pay off some of your creditors. In my experience, the OR is very good at finding out about money people have and it could well mean, at the very least, that you are not discharged from b/r after only one year if you are not honest.
As for threatening letters etc, ignore them. Once you are bankrupt a creditor has to go through the OR and can not pester you for money. There is nothing they can do. There is no point trying to makes deals/payments now.
Don't be nervous about going bankrupt. All will be well if you are open and honest and do it with the best of intentions."The path of my life is strewn with cowpats from the Devil's own satanic herd!" Blackadder0 -

You must declare it. Not to do so is an offence.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

That is what you are legally required to do.
And if you think that the OR isn't going to ask what has become of large cash withdrawals then you are in for a nasty shock.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
