Your views and advice greatly appreciated

Hi Everyone,

Was after a bit of advice and, maybe, some reassurance to a few queries I have regarding bankruptcy.

I am currently living alone and will be moving in with my girlfriend in a couple of months. I will be declaring myself bankrupt in May.

To move in with my girlfriend, her tenancy is up in June and will be getting renewed with my name on it. They are doing credit checks on me now though, in time for the June/July move in.

What will be the situation with the OR regarding the tenancy agreement. With it being rented through an estate agents, can we ask the OR not to contact them, and for us to provide tenancy agreement and proof of no arrears? My girlfriend has lived in this house for a year now and is settled there. The last thing I would want is for me moving in, being BK, affecting the tenancy.

Also, as my girlfriend is self employed, her wages fluctuate, so I may be responsible for paying all if not most of the £500 per month rent. Will that be acceptable to the OR?

Would I be able to resubmit a new I/E when I move, as it will greatly affect my outgoings.

Any help will be gratefully received.

On balance, if there are no arrears then they tend not to. My girlfriend has lived in this house for a year now and is settled there. The last thing I would want is for me moving in, being BK, affecting the tenancy.The only way to be 100% certain about that, is not to put your name on the tennancy agreement.

    Also, as my girlfriend is self employed, her wages fluctuate, so I may be responsible for paying all if not most of the £500 per month rent. Will that be acceptable to the OR?A household budget is never "cast in stone" but the O.R won't accept you trying to increase your expenditure to avoid an IPA. I'd imagine the question there would be "how did your partner manage to pay the rent before you moved in"?

    Would I be able to resubmit a new I/E when I move, as it will greatly affect my outgoings.The O.R would expect you to submit a revised I&E Budget whenever there is a change in your circumstances.

    Why not delay moving in with your girlfriend, and then the chances of having to pay an IPA would be greatly reduced?

    Realistically, when two people share accomodation it's going to reduce the outgoings of each individual.

    Be aware though that some tenancy agreements have a bankruptcy clause in them so you should check this if you can!
