Clearing a CCJ

Can anyone help me?

I've recently started a new job which is quite well paid (for me anyway) and I can suddenly afford a new car and a house etc.

I'm desperatly trying to build up my credit rating so that I can do this -- and by following tips I've read on here I've obtained a credit report. It shows the only outstanding CCJ to be for £100 in January of last year. I knew nothing about this, and so rang the county court, who told me it is from the DVLA.

I did own the car with the registration number they gave me, but I sent off all the paperwork when I scrapped the vehicle, and have never had any communication with them -- surely they can't ruin my credit rating for another six years for something I haven't done can they?

Any help would be really appciated.

    If you hadn't kept your address details up to date with the DVLA, then i don't think there is anything you can really do. If your details were up to date, then it is possible i believe for the case to be reheard. Not sure how much this costs or the likelyhood of success though.

    Edit: £60 for a set aside application
    Also may be worth putting a note on the CCJ on your credit report explaining what has happened.

  • I don't really know much about this area, but surely if the OP had already sent off all the relevant paperwork to show that the vehicle had been scrapped before changing address there's no obligation on him to then update his address details with the DVLA?
    I thought you were only required to keep your address up to date for a vehicle currently registered to you, once the vehicle had been scrapped there was no need for him to have any contact with the DVLA?

    Just a thought - I'm sure someone wiser will be able to correct me!

    You're quite right NTJ - but the DVLA could just turn round and say the paperwork was never sent as it was never received so he must be trying it on. If it was sent by recorded delivery then he may be able to get the decision overturned, but failing that...

    You can apply to the court for the CCJ to be set aside on the grounds you didn't receive the summons.

    Can i just add though that i applied to the court for a ccj to be set aside as i didn't receive the summons but it was upheld anyway.
    In my case i was already paying a set amount each month (no arrears) but they did use the argunment that if a matter is not resolved you still proof of letting them know of a change of address.
    (i had advised of a change of address but had no proof of postage, just photocopies of letters)
    Total debt at LB Moment (Nov 2007) = £6583 £4649 20.03.09
    £5060 Black horse Loan - £4114 as of 20.03.09
    £940 o/d with hsbc - -£535 as of 20.03.09
