Marlin Financial services

I am in the same boat as many on this forum regarding Marlin.

I am trying to find out if this company are actually taking people to court or just trying to scare us. Many people have been threatened but i can not find anyone on the forum that have actually rec. court papers

Also wondering if anyone has ever rec. a CCA from them or not. If not has the debt bounced back to the original company.

Just trying to get an overview on how good/bad this company actually is!!

    i did read that one but they do not say if they have actually rec the papers from court (unless i read it wrong) just that they have been advised that they will be taken to court.

    So many people are complaining about Marlin (including me) but no one has actually said that they have been to court or even rec official papers from court/Marlin

    Have you complained to the OFT, TS, FSA?

    These companies only get away with it because no one, or very few poeple complain.

    You might want to read it again.
    Issue date of the claim was 29 Feb and I acknowledged service on 11 March giving me until 28 March to submit admission/defence (on acknowldgment of service i ticked the box to defend part of the claim as I was not sure of the CCA procedure then)

    And later he has to submit a defence and fill out an allocation questionnaire.

    i am in the process of compiling my evidence hence why i started this thread.

    i have also requested my cca from them so i will wait to see if this is added to my complaint!!

  • I went to court with Marlin :huh:

    I have had a DMP for 2 years, last October one of my credit card debts was sold and they immediately defaulted it, Marlin pursued it (papers and all) straight to court, a (large) judgement was made but I requested a re determination. It was at this re determination that I got my first chance to appear in Court (months of stress in two lines).

    I had a letter and my I&E from Payplan and loads of other stuff I didn’t really need.

    The Court only allowed 5 minutes for this and Marlin didn't show!!
    I sat with the Judge, she went through her paperwork on me asked me some questions about my DMP and the history of that one particular debt, she then made the judgement order in my favour.

    I think I may have walked out backwards bowing and repeatedly saying thank you until she told me goodbye and I turned and ran before she could change her mind.:p

    I'm not sure what is happening about the interest they wanted to charge and I now have a CCJ but then I'm not going to try and get credit for many years anyway. One other good thing has come from this I no longer fear the CCJ!

    Just remember owing money is not a criminal offence and the judge is there to make an impartial decision on behalf of both parties.

    I do have to say I can only comment on my experience, since my DMP I have kept to all my payments and this was the first creditor to actually take me to court

    Oh but it appears my sense of humour has finally come back :j
