has anyone had court papers thru from marlin

hi all we joined this site 2 weeks ago when marlin said they were taking us to court for a debt they had bought from hsbc even thought we have been with payplan for 2 years and been paying them regularly . sorry for long story but its been over a week now since that horrid phone call and we've had nothing has anyone else had this and will it come!

Its scare tactics ! Did you phone them ? I hope not . Carry on with payplan . A court would see that you have been with payplan and I doubt would increase any playment plan to marlin. In the meantime I would CCA and notice of assignment request them .0

i rec a letter from Marlin as they have just purchased my Sainsbury card and they stated that as i am a home owner they will be going for a charging order.
i phoned them and they said that unless i pay 205 a month ( i pay payplan 150 in total) then they will take me to court and get a charging order against me. I have therefore asked for a copy of the CCA. If they can produce that then they will probably try for the charging order!! we will see

As stated on this site MILLONS OF TIMES never phone these people ! You will now be bombarded with phone calls ! They are trained to get blood out of a stone , they will hassle you into paying more than you can afford . Please contact them by letter only, DO NOT TALK TO THEM .0

Yes we are a home owner and they said the same to us which we have been told by both pay plan and cab that we have to default on the ccj that is set by the court first before they can apply for charging order cab said that they will try every under hand trick they can to pursue the charging order first but i'm not as worried as i was cos something came back to me that they said in the phone call they said (marlin)that they cannot accept payments that will take over 12 years to clear the debt my car finance finishes soon and that addition to pay plan will bring the time to clear all debts to within that. Again sorry for the long time replying have been busy trying to raise some cash0 -
have you actually rec. the court papers as they are using the same tactic on me... but so far no court (although i have sent off request for cca to them)0
