How long have I got????

Hey all, Ive been watching this forum for a few weeks now, nice to see that some people are prepared to say a few kind words to others in a sticky situation - sort of restores once faith in the human race.:D

Our story reads pretty much along the same lines as most of the others,we are in the process of filling in the forms online to declare ourselves BR, we are in the dwang personally for about 28K on the personal side but have a small lmited company which is in for about 19K so all in all,around about 50 grand..!!!!!!(Oh so thats why I cant sleep at night , its getting clearer already, good thing this forum...). I fully accept that a combination of bad luck, bad planning and bad decisions on my part, are what have led us up to this point and am prepared to accept the consequences whatever they may be.:(

Ive always said.....should they take everything Ive got and I am left homeless on the side of the road with only my wife and two dogs.........
I am still a wealthy man.

A few questions if anybody can help out.

Our loans with HSBC have now been handed over to a collection agency who have notified that they are going to let their hounds loose on us and will be visiting shortly to take a few bits.:cool:

1. How long does it take after sending in the forms online before you get an interview thingy to declare yourself BR??
2. Is there any way of stalling these mongrels before they arrive at my door?
3.Do you have to let them in to the house.

I'm sure there will be more questions as we are going along, so any help will be appreciated.Right now if youll excuse me i'm going to go and throw up.............!!!!!!!!:mad:

    Hi Justin , welcome on board !!

    The debt charities have to be the first port of call & you will likely know this from reading other posts.

    I can`t answer your questions specifically but health & family - yes dogs count as family(..in mine anyway) make you realise that `wealth` really isn`t about money!!

    Also don`t let anyone into your home!! You don`t say if you are renting or have equity in your home..is BR the only option?

    1. How long does it take after sending in the forms online before you get an interview thingy to declare yourself BR?? You have to contact your local court to arrange a date for the BR hearing first. The interview with the OR follows at a later date (usually)
    2. Is there any way of stalling these mongrels before they arrive at my door? Its unlikely they will call-though it could happen. They use this threat all the time. I had two or three of them, yet no one called.
    3.Do you have to let them in to the house. Don't open the door to anyone you don't know.

    Have you rung one of the free debt agencies for advice? the judge will want to know you've done this and are aware of the implications of going BR.

    Our loans with HSBC have now been handed over to a collection agency who have notified that they are going to let their hounds loose on us and will be visiting shortly to take a few bits.:cool: The only people that can take things from your house are Court appointed bailiffs, and only then after you've been served with a County Court Summons; lost or not defended the summons; had an enforcemet order issued against you and not responded to that. I would guess that it's only scare tactics.

    1. How long does it take after sending in the forms online before you get an interview thingy to declare yourself BR??Ring your local Court and make an appointment as soon as you can, after the on-line forms are completed, i.e. don't make an appointment before you can complete the forms.
    2. Is there any way of stalling these mongrels before they arrive at my door?Unless you've got CCJ's, and Enforcement Orders against you it'll take at least a couple of months before there's any chance of bailifs appearing.
    3.Do you have to let them in to the house.No, never under any circumstances let them in the house; keep doors and windows locked, and park your car away from the house if it's got to the point where bailifs are likely to come round.

    I'm sure there will be more questions as we are going along, so any help will be appreciated.Right now if youll excuse me i'm going to go and throw up.............!!!!!!!!:mad:

    the moment you are BR you are protected from the hounds....
    soooo i would suggest geting to thr court asap if possible

    If you have a CCJ you have defaulted on then yes, bailiffs can come to the house- tho cred needs to get a warrant of execution/and you need to actually open door to bailiff in the first instance, and there is a form (N245) you can fill in to stop them till you get the payment order sorted.

    If its not got that far- it seems a common scare tactic from creditors- they sort of hint that a doorstep collector has the rights of a bailiff ( to say they do have the same power outright is illegal). I had this kind of letter in the run up to my bankruptcy- I would have bailiffs/attachtment of earnings/even prison- what they fail to say is its a long route to take to get to this,and its up to the court- not the creditor.

    They threaten a lot- but it takes a long time to get to it- I sent token payments of £1 and told them I was looking at my options ( well I was- it just happened to be bankruptcy)- and they did back off for a bit.

    Hi,
    Don't let them into your house. My understanding of it is that if you do, even once, they've got permission to break in at any point in the future when you're not there.
    They may also ask you if you'd "prefer to discuss it inside". No! Just don't let them in. If the police turn up to assist, its only to "keep the peace", not to aide the bailiff.

    A "collector" from HMRC (who - it seems - are all powerful) tricked his way into here saying i knew he was coming and wanted to see me, I didnt know, i was out, but it seems he can do what he wants......

    anyway, after 2 visits they sent me a CCJ.
  • Thanks guys for the help so far, Its given me a bit of peace of mind.

    I was worried about them(debt collector etc) being able to force their way into our house when I,m not there and my wife is - I think they may have a problem if I answered the door(I'm fortunate to be 6 ft and about 3 ft wide in the shoulders with bad hair and if you catch me on the wrong day , attitude to match)-not that I'm advocating violence of course........failing that my dogs would be up for a bonus feed(mmmmm, nice fresh debt collector)

    So far ,
    we have been through the sending our creditors one pound a month - needless to say they were less than pleased.

    We sold our house to pay off a lot of the debt, so we are now renting. I am a bit worried about this as I would prefer that they didnt contact the owner or letting agent as we struggled to find this place which has the right security we need for our two rescue dogs(Bailey -8.5 stone Rhodesian Ridgeback and Stig -English Bull Terrier)it doesnt say anything about BR in our lease agreement but as you all know they do ask about it in the online forms.
    We have got rid of all our store cards over the last two years and our credit cards bar two. Apart from those its two loans with HSBC and a small overdraft and one loan on the business side through my business that we stood surety for with Lloyds TSB and also a small overdraft.As I said before about 50K in all.:mad:

    I would have considered an IVA but unfortunately I dont have a fixed income every month and nor does my wife as we both work for ourselves, me as a boatbuilder and she does a bit of signwriting and Quantity surveying from home, so we were told that we cant enter into an IVA agreement.

    If I owed anybody personally I think that I wouldnt have considered going BR, my conscience wouldnt allow me too,but hey ho the banks only made about three billion profit this year so Im not going to worry too much. :cool:

    Also , we have set up the old Co op account already, the cash saver thingy, but havent yet received the confirmation yet. Should we declare it - it has no money in as yet or will they be able to pick it up from the system somewhere??? or should we tell them and request that we be able to continue using it as we have to set up a few DD from it.

    Many thanks guy once again,but as Im sure you all know this worrying thing never goes away its always in the forefront of ones mind - or so it seems-and as such questions continually arise.

  • Question 5.4 on the Staement of Affairs asks you to list any bank accounts that you currently hold so, yes you must mention the Co-op account. It also asks you for the balance off account, so if its still empty simply put £0.00.
    You'll be asked, in your brief call to the OR after the court, for any bank accounts details. You can then explain the account. The OR will then, in all probability say, that they have no interest in the account.
