Hi does anyone know the answer? I have a mortgage offer owever there is a condition that I must repay a couple of credit cards. They don't ask me to send any evidence that I have. Will they check this has been done before releasing the funds?

    You must assume they will if it's a condition of the loan

    By putting it as a condition of the mortgage they put the onus on the solicitor/conveyancer to check that these items are repaid.

    Some conveyancers can't be bothered to get involved with it and so they just tell you to do it yourself, as if you don't pay them off, it's you that may have to deal with the effects of struggling to afford the new mortgage payments and the card payments

    We are going to solicitor to sign deeds for our remortgage and one of the conditions is the extra funds we borrowed is to pay off debts. I spoketo him on friday and he wnats confirmation of amounta dn who the funds have to be paid to as he will be sending money direct to them.

    If this is the reason for extra funds give the solicitor the details then you will know it is dealt with.

    Differs from lender to lender. Some insist on the solicitor repaying the debts. Some simply say that you have to repay them but don't check & throw the onus onto you (Chelsea are an example of this).
