capquest. .New Tactic

They just rang out the blue asking for my partner. so he passed phone to me as he was worried hed say soemthing wrong.
they said can we confirm your name and address etc . So i said no!

she was so rude and like you have to give us these details . i was like no i dont . and in the end after letting her rant about how it was illegal for me not to answer her questions i hung up.
I rang back and asked to speak to a manager who said that we had a debt with them for 1250 and that we can only sort this out over phone till i pointed out the fact i could write and unsolicted calls was against oft guidelines etc then he suddenly changed tack to im myu opinion you should sort it out over phone . i have told him that he will recieve a letter responding to there nasty letter they sent yeserday (first correnspondence)
but hes like well we can continue to ring to we recieve that letter so i have told him what i will say everytime they ring

which is "we will only deal with you in writting and if you continue to harrass us you will be breaching the oft's rules" he said ok and hung up

Good on you, and the next time they call, ask him to confirm a) his name & b) where he's calling from, then inform him you are recording the call, even if your not).

    Watch the reaction :D

I had that with a DCA called collect direct uk today. I told her I wasn't prepared to talk on the phone, I wanted everything in writing and I'd be writing to them this weekend. A scary tactic was that she was trying to sound really nice, and offended that I wouldn't talk to her and things. She also said that they wouldn't accept my £1 offers, well they'll have to because that's all that I've got!
Unless I say otherwise 'you' means the general you not you specifically.
  • I hate Collect Direct. They're a pain in the 'you know what'. I owed M&S £1500. collect direct gave a settlement figure of £1100, saving me £400. I paid them £400 and was about to pay them the other £700 just now when they said, "The settlement figure is now £900." So i told them £700 is all i'm offering. I told them if they choose to take me to court i will make clear that i made a very fair offer that was refused. He said he will confirm his refusal in writing. he was rude saying, "You don't know what you're talking about. You're not talking sense." He talked over me and interrupted throughout the call. In the end i told him that he was not listening and the only way to communicate was in writing, either by email or post. This way too there's a record of offer from me. I'll just have to wait and see how this plays out but I currently work in the lower end of the legal system (meaning I have to pay my debt either way) but i've seen guys get arrested on the friday for money warrants worth thousands, get out of jail on the monday morning and the debt is wiped clear. Easy if you don't mind the credit rating being smashed. Good luck with clearing this.
