I need help/advice please - debt recovery.....

I wasn't sure where to put this thread - so sorry if it is in the wrong forum but I need help please..:cool::huh:
....can anyone give me any information/guidance etc on Debt recovery companies?
Can you use a Debt Recovery Company to pursue a personal debt? (ie. someone personally owes you money - no purchases etc involved)
Is there a set procedure Debt Recovery Companies need to follow?
Do Debt Recovery Companies need any license or anything to collect debt on behalf of people? Or are they governed by anyone???

I think you may be better looking at the small claims court first. Have you tried that route?Total debt at LB Moment (Nov 2007) = £6583 £4649 20.03.09

Its actually someone I know on the receiving end.......1st they heard is a letter from a company.....they don't owe anything and the letter is very strange and we were wondering if there were any specific practices supposed to be followed at all......

Has your friend checked whether the old friend has obtained a CCJ against them? Alternatively has a case bee taken to the Small Claims Court?

Thanks for the OFT guidelines - thats very helpful - I think its fair to say many points within the Guidance have been broken.....
I dont think CCJ or Small Claims are involved at all - this is the 1st notification of the debt so I wouldnt have thought either of those would be possible would they?
besides which - there is no proof any money is owed - and if there is "proof" it will all be fraudulent......
I'd rather not say publicly who they are cos we have many suspisions - if we google the company or look on yell.com, BT, Thomson and other sites they do not come up anywhere - absolutely nowhere......and their website is under construction...
Surely the 1st stage isnt sending a letter giving less than a week to pay or legal proceedings will be issued tho is it????0 -

If there has been any court action, your friend should have received notice. Sometimes this does not happen because the person has moved/was in hospital etc, but they can often get the judegement overturned in those situations.
If you spend some time round here you will find that the less reputable sort of DCA send out all sorts of stuff out, which very carefully skirts round the OFT Guidelines - if is is not paid by last week (Seriously) we will refer it to our legal department who may take legal action - when they know there is no legal action they can take. Alternatively there letters are designed to look like court papers.

Thanks very much for your help - it has helped a great deal and we are consulting legal people re. action to take cos TBH this is just another part of a long campaign of harassment and more.....
The letter recvd has gone to the old address so there is def no previous letters from court or anyone else.
