An outstanding debt - please help!

Some years ago I took out a 3 year interest free deal for a new sofa (credit with First National). The final payment was due on 01/08/07 but First National cancelled the DD and sent me a bill instead on 16/08/07 for £75.12. This bill did not give any timescales for payment and I paid this in full on 19/09/07 but since then I have has nothing but hassle from Activ Kapital the Debt Recovery company.

Somewhere along the line I have been given a Defaut Notice and and extra £15 charge. I was blue in the face trying to explain my situation to Active Kaptial but they just wouldn't listen. I have refused to pay this extra £15 and written a letter to them with a copy of the letter dated 16/08/07 from First National.

Eventually today I have received a letter from Ativ Kapital saying 'as a gesture of goodwill' (!!!!!!!!!) they have closed my account and will not be pursing the £15 BUT the default notice stays on my account for 6 years noted as 'satisfied'

I've rang them again today to explain that the default notice is very unfair as I have never received any prior notice of this from First National and as far as I was concerned the debt was paid on 19/09/07. They've tod me that the default notice was entered on the 18/09/07 - the day before I paid grrrrrrrrrrrrrrrrrrrrr :mad:

The question is - should First National told me prior to 18/09/07 that they were going to enter a default notice???

It all works out good in the end.
If it's not good, it's not the end!

    Have you got a Default regsitered on your credit file? If you are issued with a notice, it normaly gives you 28 days to pay before a default is regsistered. Might be worth checking your file if you haven't already?
  • Yes - the default is registered and noted as 'satisfied'. I never received anything in the post about a default notice from First National and only found this bit out recently.

    But it seems all just a bit quick

    First letter fom First National dated 16/08
    I paid on 19/09
    Default registered 18/09

    It all works out good in the end.

    If you believe there are inaccuracies on your credit file, I'm sure you can raise a dispute with the credit agency you obtained your file from.

    I remember some years ago,when I obtained my credit file, Halifax showed an in correction, I raised a dispute with Experian.

    Experian contacted Halifax, and my file was amended within 28 days.
