old debts with different address

just a quick question, and probably a stupid one. My husband had a history of bad debt and is now ok. Mackenzie hall wrote via other addresses last year ( HIS MUMS HOUSE AND OUR OLD ADDRESS) with debts that were more than 6 years old which we stupidly paid as we didnt know the law.

My question is if my husband failed to tell lenders that he moved address is he then in the wrong ?? and a debt that would otherwise have been written off would then become liable to him as he didnt update them with this information ?? thanks karen

    The debt is always liable to the person who took out any agreement regardless if you move address and fail to pass on details.

    In your case, the debt collector traced your husband, and although the debt debt may have been over six years old and would have fallen the catagory of being "statute barred" ie the collector could not of enforced payment throught the courts, and asked for the outstanding money.

    But like a lot of people, you did not know your rights and fell prey to MH who are well known for purcashing old debts that fall in this catagory and get people to pay what is owed.

    As you say if you had know your rights and told MH that you believed that the debt was Statute Barred - they can ask you to pay and they would say morally you should pay the debt, but that is all they could do end of.

    But once you acknowledge the debt by making a payment to the debt - the 6 year time clock starts again from that day.
