ccj from drydens lawyers on behalf of egg- help!!

hi just had a ccj form in the post from dryden lawyers on behalf of egg. bit shocked as just setting up dmp with cccs with this debt included. is this normal? i thought ccj was far further down the line?

brief outline of situation is:
we missed 1 possibly partly 2 months payments with egg and while setting up the dmp i have made 2 token payments one for april and one for may (that have been cashed) to egg. we have only had 2 other letters from drydens one basically saying that the debt had been passed to them and the other despite us communicating in writing, saying we haven't bothered to contact them and to stop futher action we needed to start paying £1200 a month to them!!:eek:
cccs told me to ignore the last letter but now this has turned up and i a feeling, shocked, scared and peed off!!

not even sure the amount they want is correct, as we have bee trying to get a full debt amount from egg without any ppi for ages now to no avail!
i assume i need to call them again today and tell them i want the exact figure we owe them not including the ppi now!? also is it worth asking them if they would accept a f&f? as possibly getting some money our way and maybe we could pay this off if they offered us a much smaller figuure before our dmp starts??

sorry for all the questions but if anyone can answer any of them i would be v grateful as i cant seem to think straight right now!

    hi it sounds like u going thru what we are but we are having probs with marlin who bought one of our our debts from a company who had accepted our dmp so I would continue with your dmp and keep telling these solicitors what u are doing regarding sort debts out with a dmp cos if it does go to court which is where we are going when marlin decide to send us the letter !! the fact that you are using a dmp will show the court that you are wanting to be debt free. I am also very scared and currently off work this week as it has made me ill with worry. good luck but get your dmp it will help if only in the way that they will write to people for you it does also stop phone calls after a while we are with payplan who are brilliant and free.

    just got dh to contact egg (as debt in his name) to get the debt amount excluding any ppi and they will not give it to him! they say they don't deal with it now and drydens do?!
    guess dh will have to call drydens tomorrow and see if they can tell us the exact amount excluding ppi? if this fails what do i do? we need to fill in ccj form asap and i am not going to pay the amount until i am sure that it does not include the ppi!hhhheeeeelllppppppp!!

    Has the debt been sold on from Egg.

    I had an Egg loan yet started receiving corespondence from Capquest on behalf of Egg, although Egg did not inform me they had handed the debt over.

    Hi pink, just deal with CCCS and let them deal with all the various companies!
    Expect a few letters, they will be desperately trying to worry you into paying extra

    Just to note cccs are only open to 6 not 8 so will call them tomorrow.

    would like to leave it all to cccs but they told me to contact egg and drydens?? they don't seem to have spoken to any of my creditors yet about any of my debts, not sure if they will to dmp is in place??

    do you think they (cccs) would call drydens and try to come to some payment arrangement rather than having to run with the ccj??

    if you already have your ccj forms you need to fill it in and get it back to them asap it will become clear as you go thru the process if ppi is included but at the mo those forms are priority we have been told that when ours come we need to fill them in and send it back immediatley and citzens advice told us that good luck

    thank you i understand wht you are saying but cccs told me to find out from egg if the debt was including ppi before we fill in the ccj form.

    You do need to send the court forms back ASAP and by recorded delivery. CCCS usually seem to advise you to 'admit' to the debt. If it's the Northampton County Court then this is what happened to me last year (Twice!!):
    1. Got court form, 'admitted' as per CCCS advice and sent forms back in time with I+E sheets and list of creditors.

    2. Got judgement back after about 10 days with horrendously large amount to pay.

    You then have a time limit where you can appeal against the judgement for no cost. I strongly urge you to do it and ask for the case to be transferred to the county court closest to where you live. Northampton it turns out is a bulk centre that processes these things like a factory and IMHO do'nt even bother to look at your side of the case. You may then get a chance to explain your side at a hearing with a judge. You will then stand a far better chance of getting the monthly payments reduced to a level you can afford.
