Not sure if this is the right place to post this but advise would be helpful.
I have opened a letter by mistake that was for some one who use to live with me in 2004 saying there debt investigation officer will be visiting.
I do not know where this person is (well I know they were last heard of living and working in the states) but have had the odd contact with them and they have told me to either bin or return any letters for them.
Do I have to let these people in when they appear.
There is know property belonging to this person at my house and I am and elderly handcapped person and this does frighten me.
I have had calls from other debt collection people over the years and when I explain the person does not live here anymore they seem to stop.
Any advice would be appreciated as one company said can you prove he does not live there as I thought they had to prove that he does.
Sorry if I am a bit confusing.
Thank you

It is not for you to prove a negative (Common Law) it is for them to prove their case. They have no right of entry. Return the mail marked 'not known at this address' If a field collector calls, and thats all they are (Not bailiffs) they must leave when asked to do so, if they dont call the police[strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

Yeah - what he said.
If someone does show up you can inform them that the person no longer lives there. They have as much right to enter your house as the paperboy - none.
Alot of the time, letters like this are sent to debtors to try to scare them into making contact with the Debt Collection Agency.
Just bin the letter and forget about it. What would have happened if you hadn't opened the letter or it had got lost in the mail?
Try not to worry about it - it isn't your debt so not your problem and you definately don't need to prove anything to anybody.
Someone might come to the door.
Can Johnny come out to play?
Sorry - he's moved away and i don't know where.

Hi Charlysmum,
I say the same as above really. If you receive any further letters from the company put a line through the address and pop it back in the post to them with a message on to advise ‘no longer at this address’. They then should make a ‘gone away’ note on the account.
Try not too worry as its very unlikely that they will send a representative round.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt.
