    If they accept the evidence of all his creditors including the I.R. and as I said they've had all documentation to prove this - what would a CCJ get them apart from a nominal monthly amount from the court ? I just don't understand how it improves their position ?

    Can they check with the DVLA what vehicles you own? Do they check by name and address??

    I believe they can. I don't know whether it's under car reg, name or address but I'm pretty sure they can. Presumerably they have to satisfy the DVLA that they have grounds for the requested check but I think they can. Maybe someone else can confirm this ?

    Yes, I can confirm that they can check ownership of a vehicle. Actually, it may surprise you all that virtually anyone can apply to DVLA to check ownership of a vehicle. You just have to have a good reason etc. but any credit company you owe money to can check quickly and easily. It is not an empty threat.

    My O/H moved in with me about fours years ago, so it's my flat on a mortgage. He's self-employed so sometimes he has periods when he doesn't work. I knew he had debts when we got together, but he wanted to sort things out himself. He said about 20k - I think it was more like 45k. He doesn't lie exactly, but he's financially illiterate if that makes sense. Anyway he contributed to our household as and when he could. For about 7 months before this all blew up in May he hadn't worked. The silly sod hadn't kept back his tax monies so he didn't file tax returns. The money went on servicing the debt and paying some off in !!!!!!'s. In May the I.R. caught up with him and the whole sorry tale came out.
    Now all tax returns are filed, he is working on a contract that finishes Sept, we've agreed an arrangement with the I.R. for installments ( owes 20kish) and touch wood they should be paid off Oct.
    Back in May he stopped paying the unsecured creditors. One because he didn't have it. Later because we decided every penny he made had to go to the I;R. as the priority creditor. He's gradually being defaulted through all the credit card/loan systems. Like Egg are now CapQuest. Because every penny is going to the I.R. he can't contribute to our household. He hasn't since last Oct or whatever but at least I understand whats going on now.
    I won't/can't pay his 20k unsecured creditors but I'm prepared to lend him 4k if we can get !!!!!!'s. Seems like a waste of time trying. But this forum has 'educated' me in debt, and hopefully once the c/c's and loans sell on their debts, maybe we can get the !!!!!!'s for 4k.
    That's the gameplan anyway - it was the best we could come up with.

    Apple, my previous message may have seemed unsympathetic... sorry.. he is a candidate for bancrupcy, but what he really needs to do is improve his cash flow, even if that means stacking shelves at tescos, when the lean times come. Being self employed does not restrict you to one trade, he should get up and find a way of keeping his working capital going. And he should realise how lucky he is with you!

    It's ok ... I don't mind sympathetic or unsympathetic. If anyone can see a different route or better way to go, I wouldn't mind being told.
    Yes he was told to go bankrupt by both the CAB & National Debtline. When his current job finishes at lease the I.R. won't be out of pocket. And he may have to go bankrupt at that point, after everything we've done to avoid it. Still all you can do is what you can do. We'll take that decision then.
    Also he's tried for the temp unskilled jobs during the lean times. Been to interviews via JobCentre but his age is against him. But he'll still keep trying that after Sept even if it's shelf stacking.
    Actually I'm pretty depressed about the whole thing. Sometimes I think the plan will work ... other times like this threatened CCJ, I think what's the point ?

    Well ... we'll just wait for this CCJ application to turn up. Maybe it's just a threat !

    Does anyone know how long it noramally takes from being told it's going to be applied for, to getting papers with court date ?
