Recorded Delivery CCA Requests

Hi there,

Over the past couple of months i have sent various creditors CCA request via recorded delivery.

So far not had a response from two, however i have checked Royal Mail`s website and the letters have not been delivered for some reason. It is now coming close to the 42 day mark. do i need to resend my original requests?

I have sent a total of 5 letters, To NDR's Registered address, 3 recorded delivery and 2 by normal post , but stiill await a response. According to Royal Mail they have not been delivered but can give me no explanation why.

I have also sent a letter via recorded and normal to Meritforce but the same thing has happened.

Should i sent the 2nd letter or do i have to start over?

Thanks in advance

Tilabi

As the letters have not been delivered, i take it they have been returned to you?
And therefore your creditors have not received either your request for the CCA or payment. I would suggest writing again and sending the letter by recorded delivery. Might be worthwhile posting up who the creditors are so others can suggest addresses - just incase they are different from those you have been sending the letters to.

Are the creditors contacting you by post or phone?

    Hi,

    Thanks for the quick reply

The creditors are Nationwide Debt Recovery (NDR) and Meritforce.

Actually none of the letters i have sent have been returned to me. Howver i have checked Royal Mails Website and Telephoned them and they have said they look like they havent been delivered.

I would not normally say phone them , but in this case you may have to. Do not get into a conversation with them just request their postal address . Withhold your number .

Having sent out nearly 20 recorded delivery letters at this point, not all have been registered with the post office as delivered? but the compnies have received them because they have actioned them in some way???????? Bit of a mockery is recorded delivery me thinks. Look for proof of checking if they have cashed the PO/cheque. A paper trail is in my opinion is acceptable after all banks and dca's in general don't send recorded delivery?

One thing to also be aware of is try not to send recorded deliveries to arrive on a weekend as many of these less than scrupulous companies will never bother collecting them if there has been nobody there to sign for them. They know that the only reason people send recorded is because they are usually making a complaint or statuory request of some sort.
