Wrongly listed as Defaulting on Mortgage by Amber Homeloans

:confused::confused::confused:
I have been annoyingly listed as a mortgage defaulter recently by Amber Homeloans for a self build i have completed and just remortgaged to pay them off so now they have my money and have given me poor credit as they couldnt get the settlement figure out to my solicitor on time before the weekend to close the account before next payment due on the 1st because of a weekend falling in between they got the figure over by fax incidently to my solictor on monday 4th therefore when we rang Amber the previous week they advised us to stop the direct debit to themselves which we have the guys name... and they could get the figures possibly out to us friday but more like the 4th on monday.. so we did this and still got charged the £600 final payment that we were trying to avoid paying and have now got a default payment listd on our credit file to which end some credit cards we ahev just paid chunks of money off have reduced our limit or closed the account completely on one which was paid in full.... where do we stand and what can we do???

    I wasn't aware that they could put a default on your file without first sending you a default notice. Not to mention thats is very very very quick to even update a credit record as companies are usuall well behind.

    Write to the company involved and tell them to correct the information they have passed to the Credit Reference Agency or else you will report them for a breach of the Data Protection Act which requires them to process information accurately about you.
    They haven't.

    Also, place a notice of correction on your credit file until it is resolved.
    Almost debt-free, but certainly even with the Banks!

    Hi,

    I have a mortgage with Amber Home Loans and also had 2 with Skipton Building Society(they are the same group).

    EXACTLY the same happened when I remortgaged one of my buy to let mortgages away from Skipton to get a better deal/rate.

    We were supposed to complete on the Friday(last day of month too) but ended up completing on Monday due to delays on their part.

    Like you I too had cancelled direct debit as 1) I was skint 2) didnt want to end up paying twice. I only noticed they had put a strike against my credit when I was checking my credit file on line a month or 2 later.

    I rang them up (think I got put through to completions, or redemptions:confused: ) was VERY NICE to them on the phone and told them it was their fault it ran over by one working day, would they please amend the credit file accordingly as I had never missed a payment.

    Sure enough they done it for me. You can write a letter in too but I sometimes think if you can speak to people, get their name, have a bit of banter and be pleasant to them on the phone it goes further than a letter.

    BTW, worst they should have done on your credit file is marked you down as being upto 1 month late in payments. Their is a sequence of missed payment sand then a default notice required before a default can be recorded against you as far as i know.

    Let us know how you get on, but I'm sure you will be fine.
