Hi, im new here and this is my first post but i have been reading for a while now.
My OH went BR in march and she is still waiting on contact from the OR, at the time of her BR she classed her self as single and was on Income Support but we have now got back together and i am going BR in May, she has now stopped her IS and all she gets is Child Benefit & a tiny amount of tax credits, she doesnt work.
1) On my SOA do i just put all my wages and the total household expenses, she doesnt really get any money to contribute, & i pay for everything. How will this be seen by the OR? Will she have to contribute (she looks after our 2 sons at home, toddler & newbron) Obviously my expenses are going to be quite high as i am paying for the whole family.
2) I work on the other side of the country from where i own my family property, i do 4 12 hour shifts every week (sometimes more) and because of the distance from home i have lodgings near my work, meaning my expenses are very high for petrol & housing.
How does this work with the OR is it allowable, or would i be better off finding a different job with less money at home. I dont really want to be lodged with a massive IPA but i know i probably would be, how are housing costs worked out. There is no equity in my home.
Can i be allowed to pay for my OH costs as well as mine when im away? Obviously there is food etc for the family & extra for me when im away, extra petrol, basically i have to pay for all the normal household costs everyone incurs but then there is a lot on top of that for me.
Monthly Net Wage - £3500 (averages between £3000 & £4300 depending on how many hours but if i do more my lodgings go up)
Contributions - Nil
Mortgage - £990
Secured Loan - £136
Lodgings when away - £430 - £560 (depending on hours at work)
Cheers lee

1) On my SOA do i just put all my wages and the total household expensesYes, and make sure you include all your expenses; there may well be things that you can include that won't occur to you; have a look through some of the Threads on here to see what other people have included., she doesnt really get any money to contribute, & i pay for everything. How will this be seen by the OR? Will she have to contribute (she looks after our 2 sons at home, toddler & newbron) Obviously my expenses are going to be quite high as i am paying for the whole family. If your O.H's only income consists of benefits that are paid as a result of having children then they can't be used to calculate an IPA.
2) I work on the other side of the country from where i own my family property, i do 4 12 hour shifts every week (sometimes more) and because of the distance from home i have lodgings near my work, meaning my expenses are very high for petrol & housing.
How does this work with the OR is it allowable,Yes it is allowable; it's a cost associated with your job. Are you self employed or paying tax on one of the contracting schemes? or would i be better off finding a different job with less money at home.Quite a lot of people take lower paid jobs while they're bankrupt, or give up work altogether. I dont really want to be lodged with a massive IPA but i know i probably would be, how are housing costs worked out. They're based on the actual cost of things like mortgages, rates and an allowed amount for other utilities. There is no equity in my home.
Can i be allowed to pay for my OH costs as well as mine when im away?Yes, they're your responsibility, regardless of where you're working. Obviously there is food etc for the family & extra for me when im away, extra petrol, basically i have to pay for all the normal household costs everyone incurs but then there is a lot on top of that for me.

Hi Lee,
You really need to post a more detailed breakdown of your total expenditure for people to be able to give you some idea of whether, and how much of an IPA you'd be expected to pay; estimates and guesses are better than nothing.
Have you taken professional advice? The Debt Charities are the best and the Judge will ask the question before declaring you or your O.H bankrupt; time spent talking to them is seldom, if ever wasted. Their contact details are in my signature.

Hi Richard, thanks for your reply.
I am employed on a 4 year contract and will be paying tax & national insurance, this averages out at about £400 a week (get paid weekly) I could go back to where i used to work but this is a lot less money, i struggled to keep on top of the mortgage etc and if i did leave i wouldn't get back on this job so id be loosing out on at least 3 years good pay. I have in the region of £70k unsecured debt and none of my creditors woud accept an iva when it was proposed a while back.
Ill have a look through the other threads and give one of the charities a call again to get an idea of what expenses etc to include and ill post back when i have an idea of my soa figures.
