So annoyed and upset

Hi All but need a rant (and advice).
DH and I have over 24k of debt. We spoke to cccs and we are paying token payment for the meantime. DH has exams coming up which should enable him to bring home more and Im taking steps to increase my income.

Anyway, nearly everyone we owe had accepted the £1 token payment, we are still waiting on our bank as we owe them upside of 10k and had to send their letters out a little later as we had to get another account set up. Our first very budgetted month has gone ok, payments made, direct debits paid up until now etc.
BUT..... today is DH's payday. He instructed his boss to change the bank details and was assured it was done. This morning i checked and DH's wage has gone into the HSBC (old bank) and we've lost £190 straight off on bank charges (overdrawn on overdraft and hsbc loan payments still coming out). I am absolutely past myself. I shot to the atm and withdrew £300 (all I can take) then remembered I could transfer to another hsbc account, which I did and DH took another £300 from that and I have done a bill payment of £96 to go to new bank. This means we've had to "take" £150 from HSBC which strictly speaking wasnt ours to take as it an overdraft left on another account. This is not going to go down well with HSBC.

DH shot of (not happy) to his work at 7am (Garage so open and boss in) and played merry hell (boss not aware of true situation but thinks we had a loan with hsbc and they were taking too much so we changed over but because £ went to the wrong place we're down on money). His poss bumbled an apology and said "It must be RBS fault (unlikely - Boss is grade A idiot so probably didnt sort it properly) and Im going to give them a rollocking". Does he have any liability for the £190 we're down??? Personally I think he does but legally? Any advice?

    Im not entirely sure but as you are trying to set up a payment plan through CCCS then it may make it harder now to get them to accept as you have continued to use the account. What I would say is that although HSBC will probably accept the plan from CCCS they will continue to add interest anyway. I am on a DMP and have been for nearly 1 year and they are still adding intrerest and our balance has gone up not down...very frustrating!

    Hopefully someone else more experienced will be able to answer your question in a bit more detail

    Thanks Sally. We want to look at dmp but cccs say its not viable at present. We have £16 after priority bills and the minimum amount allowed for food etc and 14 creditors so this is why £1 each. HSBC havent received the paperwork yet and Im hoping they wont cause a big fuss because we are now within our limits of o/d (as all owing was taken). I was so pleased at how well we'd budgetted and have used quidco, surveys, cost cutting, menu plans etc.
    So annoyed that its been made difficult by this idiot and dont know whether its worth persuing further

    Am sorry i cant help you i do agree that his boss was wronf he should have changed the account straight away but legally i really dont know.
    I know that when we changed our bank we had to give 28 days notice with work and we didnt so got them to pay us via cheque for the first month.
    But i really dont know sorry.

    Good look trying to get HSBC to even acknowledge letters from yourselves if it even concerns CCCS.

    I went through these years ago to try and sort myself out, HSBC are still threatening me now 5 years later I owe them £1600 which was there fault in the first place as it started with a £200 overdraft which was used and then I lost my job and couldn't pay it back. They just kept adding and adding interest over the years. My letter from CCSS was sent to them and ignored. They have threatened me with debt collectors and court action for the last 5 years. Still I have no money to pay them off.

    Lol, gets better and better. Im thinking theyll probably acknowledge me as i owe them so much. They can either do that or pay to bankrupt me (I rent, £300 car, no assets so no financial gain - only loss in them doing that).

    I hope not. The only thing we have which is our is this tenancy and we'd lose it if we went B/R. (Tenancy agreement very clear on that).

    I don't know if the boss would have any liability legally. We owned a company employing 7 people for about 11 years and we wouldn't have accepted any liability. If any of our employees ever changed bank accounts (and they did) I told them to give me the new details the month before, so we never had an issue.

    You could try calling the CAB to see if they know. The only thing I would say is be careful how you approach the boss - the last thing you would need at the moment is DH losing his job altogether.
