Grrr - Eversheds, urgent advise please!

Has any one had many dealing with Eversheds. DH had a loan and credit card with Egg Plc which was eventually passed onto Eversheds (DCA)

Anyway, like all of our debts, we pay by monthly standing order. We have been paying Eversheds an agreed set amount for about 2 years with no problems.

Two weeks ago dh had letters from Eversheds threatening legal action because we had supposidly missed payments. (We never have!) Surely they should have been asking for a review of the account?

Anyway, we wrote back to them stating that we hadn't missed payments and enclosing our recent I&E form explaining that we can increase payments but only by a very small amount.

Today, more threatening letters have arrived, they have totally dismissed our letter and I&E form.

DH tried calling them this afternoon but without much luck. It was either pay up (not possible) or its going to court.

What do we do now. My stomach is in knots and dh is just not talking about it.

  • If you haven't missed any payments, and can prove it, then it might just be better to let them take you to Court, file your defence, you may be pleasantly surprised. Courts don't take to kindly to DCA's clogging up the system when they are already getting their money

    Hi there, i had dealing with Eversheds with my Egg loan, i didn't have any issues other than they were always on the phone and chasing payment by 28th and i had variable pay dates which they weren't happy to believe somehow! they thought i would always pay them on a certain date.

    Is that maybe what they mean by missed payments, maybe missed their own specified dates, but payments were made.

    Call up and insist to speak to a supervisor and go thru each of your payments asking for verification as to where they were missed? If they can't provide dates then i think itsnever2lateisit may be right.

    Hopefully they will see sense, it's a case of getting the right person on the phone isn't it!?

    This'll bump your thread anyhow and you might get more help.

    Did you ever request a Notice of ASSIGNMENT or a CCA ? Many people are finding these DCA are buying unenforceable debts from the OC at 15p to 20p on the £

    DH has never requested a CCA from them because we still have the original agreement and fully acknowledge the debt.

    DH has written to them again today requesting proof of missed payments and stressing it wouldn't be in interests to take to court etc.

    We'll just see what happens now.
