Please can you guys help me out with this.
I owe american express £2700.00. I have been unable to make the min payments for some time, I have contacted them with a statment of accounts and offering them £25 per month. This was not enough so they sent the dept to a dept collectors.
I have offered them the same offer, no good £10 per month min. No way I can do this. They have said that because I have not made a payment over the last 3 months they will pass it to the legal team who will start the backrup process.
Please can some one explain what this all means as they are being so nasty, saying I will not be able to get a bank account, a Job or passport ect.
I have managed to deal with all of my other debt, all intrest free and very minimal payments.
Im really upset about this and its begining to affect my work.

Can you set up a standing order for the £25 a month so you can show you are paying something? I have 2 creditors that wont accept anything if its not the amount they request, so I have set up SO online for £1 a week.0

What will it do by paying them a small amount they wound not take the £25, they have said that if im not able to pay the £100 they will take me to court. So why should I pay. I dont mean that as it sounds but if they are going to push it further anyway should I give them the small amount.
I dont own my home or a car only a bread machine and a few text books0 -

1. You need to pay them £1 per month minimum to show that you are intending to pay the debt. Beyond that, they are not allowed to demand more than you can afford, but they could ask for evidence that you are not affording loads of booze and holidays. They are breaking OFT Guidelines here.
2. In theory, any creditor can make you Bk for a debt exceeding £750, but they have to pay the court charges and the costs of lawyers etc. And if you are BK, they will only get back whatever money the OR can extract from you after normal living expenses etc. Given what you have said, you would not be liable for a Payment order, so they would get precisely nothing but incur an extra £1500 costs. Not likely. So they are breaking OFT Guidelines again by implying actions that is unlikely and by abusing your lack of knowledge of the law.

This is complete cobblers and definately needs to be reported.
You will be able to get a basic bank account even if BK (and you will not be), from which you can pay DDs, and get a solo or electron card.
You will not have problems getting a job unless you work in one of a very few areas in finance and law where being BK is prohibited.
And no-one at the passport office cares about your financial state.
The liars.

IF they do take you to court it will look good that you are already paying what you offered (and they refused).

You need to write to them and advise that all comms will be in writing in future, given the nature of the unfounded threats that they have made on the telephone. They are required to remove your phone number from their records if you demand it.
You also need to sort out a Standing order for £25, if that is what you can afford. Then if they take you to court, you can show that youi are making efforts to pay the debt that are reasonable. No judege will force you to pay more than that.
On the other hand, have you spoken to any of the debt charities about your situation?If you've have not made a mistake, you've made nothing0 -

They do not seem to feature too often on here (JUST BEEN SEARCHING) but their general bad manners and contempt for OFT Guidelines come through ion what is here.
I think you need to change the title on your thread (hit edit on your first post) so that it refer to Allied. That will attract the people who know them.

I am writing to you to inform that I request all communications to me in writing. I do not want any further telephone calls made to me.
To continue to contact me by telephone after I have requested you not to constitutes harassment. I require all future communications in writing for future court use. Do not telephone me again – remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines, as are the unfounded threat made by your operator. If you continue with them after the receipt of this letter, an official complaint, together with a log recording the times and frequency will be passed both to that office and to Trading Standards, For your information, all telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’. In that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint to the relevant authorities will be made.
Take further notice that continued telephone calls after receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
Communicate in writing and ONLY in writing. Your telephone calls will not be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.
