Quick...ish question

Hello:hello:( a serious post but that wavey hand emoticon fascinates me and ive only just found out where to get it:o)

I want to post my i & e early this week coming with some background info to get some points of view from this godsend of a forum but i still need to fine tune the accuracy of the one i have before posting.

Please note:i know this question is under scottish law but id really appreciate any thoughts anyone has and its not really a legal question specific to scottish law

i would appreciate some advice and opinions on which i kind off need to move quickly as im in the middle of searchng for a new job just now after a bust up with my boss last weekend.(which has settled down now but left a sour taste in my mouth)

im employed as a chef which as some may know is a high pressure envireoment with lots of various targets to meet and physically demanding with long hours.
Whilst im happy enough to work under pressure i do begin to feel that at 43 its time to look for a job that has more of a steady day and leave the high energy stuff to younger lads n lasses.(happy enough to keep cooking just at a less physically pressurised level)...(Im not so concerned in the short term but if i enter a trust deed on my current salary im not convinced id be able to continue for the 3 year duration of a trust deed and im unlikely to find a similiar salary back home anyhow

I ve seen alot of jobs this week that fit the bill and id love to apply for them but the dilemma is the salaries are 5 to 10 k less than my current salary.
ive been advised by the CCCS to consider a trust deed (IVA) with BR a real option based on my current income and outgoings , but the drop in salary would most likely take a trust deed out of the equation, i know im going to find it hard enough to convince my wife that a trust deed is our best option and shes totally against BR which is fair enough and i respect her point of view.
I do understand a trust deed can be reviewed if there is a change in circumstances but in all truth both my wife and i need to put a line under all this now (I know the debts are having a terrible effect on her health and my working away from home means she is the one that has to face the phonecalls and letters through the post and committing to a trust deed would also mean id have to commit to a further three years away from home).....and just to add to the dilemma i think a BR would be refused just now even if my wife was to agree as after essential living expenses it does show surplus that makes a trust deed the most likely decision of the courts

So i guess what im asking is based on the info above can anyone see a decent option or another point of view as frankly i feel caught between the devil and the deep blue sea on this one.

    Hi there,

    I haven't got any real answers tbh, just wondered why your wife is so against bankruptcy? I do think judging by what you've said that it could be your best option since it would mean no further calls/letters for your wife to deal with and would also allow you to find a job in which you're happy (which I assume would also make your wife happy?) It would allow you to make a fresh start.

    Of course some might say that the trust deed is best but 3 years is a long time to be working in a job that you don't like IMO

    Sorry I can't be of any more help, hope you find the solution thats right for you.

    It sounds to me like waiting until you have a new and lower paid job and then filing for BR is your best option. I went BR when my health meant I had to work part time and couldn't keep up with my repayments. The advice I got was to stop paying my creditors as soon as I had decided to job bankrupt which I did, even though it took me 6 months to save up all the fees.

    I understand your wife being against BR but it does alleviate all that stress - I have a serious chronic illness myself, and it's helped massively.

    If it were me, I wouldn't do anything until I'd found a new job, and knew exactly what my income and expediture was - it's possible to amend payment orders etc after BR, but it's easier to wait until things are on an even keel.

    Persolv0 , glad you managed to settle the disagreement with your boss last week but totally understand how you feel about the job. I`m similar age & that `fast lane` stuff is wearing bit thin!!!

    Sometimes you have to take a few steps back to make great leaps forward & I wonder also why your wife is so against BR especially if CCCS suggest it as an option. It would certainly give slightly more allowance in I&E as well as shorter timescales...have you sat down with OH to discuss figures?...easier said than done...I know.

    You have done so much in the last week & I can tell you are trying to sort situation for benefit of your family as well. The phone calls are not nice.. I have to take them for my OH & they really get you down - your OH will need to be pretty strong to deal with them!!

    You need to recall CCCS & discuss realistic earnings potential & see what that results in terms of IVA /BR .

    Anyway clocks forward so really is 1.47am now!!!

    Just wanted to relate where you are comming from. I too was in a very phyiscally demanding job with long hours(also OH worked at same place)but my debts kept us there for various reasons. I never wanted bc either and looked into doing an IVA but my level of debt was too great for my income so bc it was.
    5 mths down the line both OH and i have changed jobs to a nice,easy,less stressful occupation,with what i consider to be normal hours.
    Do i regret anything? YES NOT GOING BC 12 MTHS EARLIER:D Hope this helps even a little.
