Help with getting tax back on fathers pension

My dad retired from a company following 30 years service and got a pension. When he went to work for another company 2 years later they started taxing him £39 a month on it because it was classed as additional income not primary income. Well for the past 15 months he hasn't been working due to sickness but the revenue has still been taxing the same, which shouldn't be right surely if he isn't working? Can anyone advise on the procedure for reclaiming this? The lady at HMRC office in our town did say there was a form he'd need to fill out, but apparently she wasn't too helpful.

If your dad is receiving more than his basic tax allowance it will be taxed, the tax office should be able to check his code and advise if he has overpaid the tax due.0

Well for the past 15 months all he has got is sick pay of £70 a week nothing else. He was getting taxed whilst he was in full time employment because it was looked upon as 2nd income, whereas for the past 15 months it hasn't, it has been his only income, yet still taxed heavily. HMRC do not know what your dad gets paid each month they only get pay and tax details at the end of the tax year when employer/pension providers submit their annual returns. It was up to your father to tell them that he wasn't working and that his tax code on his pension needed to be adjusted.
It is very simple to get any overpaid tax returned. He can complete an R40 form - http://www.hmrc.gov.uk/forms/r40.pdf using the details on his P60's which he should receive by the end of May. He can attach a letter with it explaining that he is no longer in employment.This is a system account and does not represent a real person.
