Hi everyone, i'm due to go to court on 8th april to petition for BR and grateful to have come across this site a while ago as i now feel fairly well prepared and informed ( although still very nervous ).However, something has come up which is worrying me and i'd really appreciate some help.I've been disputing a debt since January and the company are using a firm of solicitors to recover it.I have received a CCJ application which is due to be heard a week after my BR date and although i've asked then to enter into mediation, they have refused.My concern is, will the DJ look unfavourably at my petition (it's the same CC), do i need to declare the pending case on my BR forms and what will happen to the debt if the case goes against me?Hope someone can help.

BR trumps a CCJ.
Tell the company you have a date set for BR, then send them a copy of your order when you get it. If they still insist on going to court the judge will not look unfavourably on you, he'll look unfavourably on them for wasting the courts time for still continuing with the case against you knowing you are BR
At this point in time there is absolutely no point in trying to mediate with them, the debt will be written off in BR.Accept your past without regret, handle your present with confidence and face your future without fear0 -

thanks for the advice and encouraging messages.it never occurred to me that the case would not proceed and although i feel confident that the DJ would rule in my favour i wasn't looking forward to it.i've just about finished completing my online forms and have another concern ( i'm a bit of a worrier!!),my wage is due to be paid into my basic nationwide account a few days after the BR date and i'll be in more of a mess, if that's possible, if i can't access it.would it be very bad of me to delay telling them for a few days?0

Hi cdboy,
You'd be better off getting your wages paid into another account (ie. a trusted friend or family member) or even putting BR off for a few days (if possible) until AFTER you've been paid, because you really shouldn't be using your bank account after BR.You can't control everything in life....... your hair was put on your head to remind you of that
