Hi all.

Not sure if i am in the right place. I have previously posted on here about my mortgage comapny. They are trying to evict me.

Basicly my husband was ill in 2006 we were already behind on our mortgage. I contacted mortgage comapny by phone and asked to make a PPI claim. I got told i didnt have PPI. So arrears carried on.

I found out in 2007 i do have PPI.

I have heard all the remarks that I should know who I am insured with ect ect. The truth is I didnt because i am dumb when it comes to this sort of think. I compalined to the mortgage comapny and they said that as a broker arranged the loan how were they supposeed to know that we had this in place.

I have found A list of disbursements and the credit agreement and they both state that I have PPI.

All i want is my mortgage comapany to agree that they have made a mistake and help me out a bit by giving me time. I know i owe the money. It is too late to make an insurance claim as it wouldnt anywhere clear the arrears and i am now behind on the loan and mortgage and the PPI will only cover the loan.

I am getting deperate now. I know i can go to court on a N244 form as I done that last month(try to evict for loan then. They now want mortage)but all my kids are disabled with diferent things and could get ill and face hospital at anytime and it is very hard to stick to appointments so i amtrying to stop the whole court thing. FOS are taking agaes as well. I dont know what to do HELP please.

    Is the MPPI through the same company as the mortgage? As if it is not then they havent actually made a mistake and are correct in what they are saying. Lenders dont have to make a note if you have taken MPPI with another company.

    It isnt with them as they dont actually sell PPI but it is on all of the origional paperwork like I said the credit agreement and disbursements of money as we borrowed the PPI money in the loan. Surely they should of said that they dont keep a note of this and send me to somebody who would know. Like I said i am just a naive customer who at the time was under quite a bit of emotional stress.

    Was this a single premium policy that you were sold? When was the policy originally sold to you?

    Unfortunately the mortgage company wouldn't have any way of knowing what you have elsewhere, but I think potentially you should be looking at the advice you were given in the first place.

    How did you actually find out that you had the policy? What original paperwork is it on....a suitability letter / policy document??

    With regards to the breakdown of funds this would have been your solicitor that did all that part. The lender just sends the money to the solicitor on thier request, who then forwards it to the relevant parties.

    Griptool gives some good advice above, a trip to the CAB would be time well spent.

    so your adviser arranged cover separately.

    So you didn't have PPI on the mortgage.

    Make your PPI claim for the loan and use the money to tackle the arrears/ keep to the agreed payment schedule. This should give you some time.

    Then you need to assess whether you can afford to keep up with repayments long term. If you income is going through a bad patch and will increase all well and good. If you have little propspect of more money each month you need to take action. If you can't afford your mortgage the answer is to maintain control and sell the property and either rent or buy something you can afford.

    Olive - forget the PPI, and forget trying to get the lender made a mistake, you are wasting your time.

    In law it is your responsibility to know you had insurance. Ok the lender perhaps could have pointed you in the right direction but they are no way culpable or responsible in law, so you are wasting your valuable energy.


    From what you say a pattern exists where you have been struggling with debt over a period of time.
    This wont change unless something in your life changes - sorry to be so brutal, I am trying to help.

    Have you thought about selling, clearing all debt and then getting rental or council housing? No council will allow you to live on the street - they have a duty of care towards your kids, so there must be an answer.

    I really wish you all the luck in the world and hope you can build a new life.
