  • Wow, that is ultra pathetic.

How can a company run themselves like that!

Send it to a newpaper, may get in the funny stories section.

As for what to do with the letter, it's probably just a scare tactic but it may be worth calling the catalogue, as you don't want the hassle of someone taking you to court.
"A bank* is a place where they lend you an umbrella in fair weather and ask for it back when it begins to rain."

(*Unless it's Santander. The branch says they sent you an umbrella 3 times already and don't understand why you don't have it yet and want it back right now!!!)

I would consider sending the info to the OFT regarding incorrect collection procedures..

There are rules etc on how money can be collected, it has to be concise and not misleading etc..

I would certainly think what they are doing is wrong and classed as harrasing etc. They also by law have to disclose who they are collecting for and ref. numbers etc.

    Sounds very 'fishy' to me.

has anyone else had a 'deal or no deal' offer from a firm called gothia (red castle recoveries).....???

    how pathetic this is'-

    DEAL

you pay £595.14 within 14 days - and you are quits.....or you can pay £25.00 a month for 25 months and then you are quits.....(amount owed £793.52)....

    NO DEAL

instruction of a doorstep collection agent to visit you
legal action via the county court

so DEAL OR NO DEAL - PLAYER DECIDES

how can a debt collection agency be so pathetic? also - there is no mention of who the client they are recoving the money from is so how am i meant to know? i know its a catalogue but the catalogues im dealing with all went back on their duty of signed cca months ago and all the letters i should communicate to them have been and gone ages ago, so, it has been quiet for about 6 weeks and now this?

any suggestions on the wording of a letter or do i just file it and not reply? would rather let them know i know they cannot send doorstep agents though....

    thanks

As you said, they cant just send doorstep collectors without court permission, also they are very unlikely to do that due to the costs of court fees, there is no guarantee that the courts will rule in their favour for this small amount.

All in all, it doesnt sound legal the way they have approached you.

Not quite right baliffs cannot call without a courts permission unless it is a legal requirement debt like taxes etc

But a doorstep collector or representative can come to see you they have no powers though and you don't have to let them in at all.

I doubt they would though it would have to be a lot of money to make it worthwhile profit wise to send a representative round so in that respect it does break OFT guidelines to debt collection.

magoogy not sure if anyone has posted the link from OFT but here it is http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf

I would write a formal letter of complaint to them and if you have requested a CCA point out they are not supposed to contact you about anything else until they have supplied a CCA.

    Cheers Rayday2,

    Thanks for the post..

With regards to the post about lowell earlier, i had a lot of hassle with them regarding a debt that i was already paying to another collection agency, i had been paying it for almost a year when i got a nasty letter from lowell that they are now dealling with the debt and i must stop paying others and just to pay them.

i rang them etc, many many times, even phoned existing collection company to advise of lowel....i sent lowells my agreements with moorcroft and payments made but they still wouldnt listen.

Eventually my CAB advisor wrote to them advising of the rules regarding unfair behaviour and OFT guidelines etc...Funny since then i havent heard anything from them since then, that was 6 months ago now..

Sounds like lowells try it on with most people using scare tactics, but if you know your rights then they back off...

    Good luck.
