Re-mortgage fees- are they legal?

I transferred my mortgage with Nationwide to a tracker account in July 2006 and had to pay £399 to change over. When I went to see about increasing my mortgage last week, I was told that Nationwide no longer charge a fee fto change to the tracker account. The advisor said, "Sorry about that." Do we have a case to reclaim the fee we originally paid?

they were the terms at the time and you accepted them.
