Help with AIC please?

Please bare with the brief history!

I have an outstanding debt with RBS/Mint that was in the hands of AIC until late last year. After much fun and games, incredible phonecalls and dogged persistence I eventually got it onto a payment plan, made regular payments through standing order, and all went quiet for about a year. At the end of last year I started receiving letters from Regal, and after checking with RBS that the account had been moved I set up a new arrangement. However the amount of the debt differed to my records. I have eventually established that three payments made to AIC were never credited to the account.

I e-mailed AIC on 15th Feb, with copies of the bank statements showing the payments being made, and analysis of the payments received by RBS to prove that they have not been credited. They advised their accounts department would look into it. I have followed this by another e-mail 7th March, and they have responded that it is still under investigation.

I am now in a position to offer a full and final reduced settlement and spoke to Regal who will accept a 20% reduction, but on the higher outstanding balance.

Regal suggest that AIC should make a repayment direct to me if they agree the misplaced amounts after I have settled but given it is AIC I find this unlikely. Any advice on how to proceed? The three missing payments total £225 and the toal outstanding is just over £2300 acording to me, and obviously Regal believe it to be over £2500 but will accept just over £2000 in full and final settlement.

What should I do next?

    Withdraw your offer straight away ! You have offered far too much ! You will now also find they will want to increase the monthly payment . Do people not read this forum ??? DCA buy the old debts for 15p to 20p in the £ . A offer of £400 should have been a starting point ! sorry for being blunt !

Sorry if I wasn't clear, so far I have asked Regal what they will accept, I have not accepted their figure, or made an offer that they have accepted, merely asked the question saying I might be in a position to make an offer shortly. A 20% discount is their opening offer.

    okay thats good. Will you be in position to make an offer ? If you do get hold of say £1200 , I would keep it as a fall back . Request a true signed copy of the CCA . Its amazing how many DCA do not have the correct paperwork ,and therefore the debt is unenforceable . I would read up on it if I were you .
  • I am not looking for a loophole to avoid paying the debt...I owe it and accept that. I am looking for the best outcome so that I can put a few horrible years behind me with a clear conscience! As much as I want and welcome advice on negotiating full and final settlement figures with Regal, I also need to know how to put pressure on AIC to find the monies I have paid but they have not allocated to the account.
