    thats exactly what happens, thats why my overdraft got higher and higher, now thankgod they wont let me go any higher.
    Thats why im stuck, i have spoke with the bank(abbey) and HFC and told them my situation but all they say is "would you like to make a payment today" ARGH!!!!

    It's also going to be worse now because im on sick pay, but the CCCS have advised me that if i am going to go BR then just to pay each creditor a £1- does this sound correct to you lo, just wana double check i heard right.

    Oh and does anyone know the websit or link where i can get the forms EX160 downloaded please.

    try the insolvency website - www.insolvency.gov.uk shoudl find all you need to know..you can also file the BR on there too...im doing mine now...must less painful rather than writing it all down...im a bloke with the worst handwriting too.

    Toon_Dave - I dont have insurance, how much roughly does it cost. i have 2cats, some people have said why don't you get rid of them, but they are my babies. ive had them for 9months now, since they were 3months old, plus they are brothers and i wouldnt want them to get split up. sometimes they are the only ones who keep me goin because they come and give me a cuddle at night..

    When i split with my ex last year, i had to rehome my two cats - - toby (had since 5 wks) was 6 years old and millie (had since 8wks) was 3 years old...it was the worst i had felt...i wasnt worried about the house or money or anything ....just the animals...so i know exactly what you mean...i had no choice as work away now so couldnt keep them at home..it just wasnt fair on them...they have gone to a nice old couple now who spoil them absolutely rotten...i have seen them both a few times and they have the 'lord of the manor feel' to them esp toby...so although sad writing this now they have fantastic new owners..

    That was slightly off subject...but Insurance . try petplan or pet protect - usually premiums are £5-10 pm but may give piece of mind for you...it wouldnt include existing conditions that they have or routine vaccinations but might give you some assurances that if any 'big' was to happen you wouldnt have to worry.

    So if i put £150 down on food, will the OR not question it even tho im living with parents?

    No, you still pay rent (board) and therefore food extra to that - just because rent (board) is at parents, you still have to eat.

    Regarding the token payments- yes you can pay £1 as a "token". CCCS advised me to do this when I was in the process of going bankrupt. CCCS also have a good template letter they can send you regarding it. I literally sent them all a £1 cheque, along with a copy of my budget-I found it DID make them back off a bit ( possibly bacause a lot of creditors do seem to respect the CCCS).
    In hindsight, I occasionally wonder why I bothered- it takes a few months before they get to the CCJ stage( and bankruptcy wipes that out anyway). If youre going bankrupt soon, its not really worth bothering with - but if its going to take a couple of months then its a way of buying you a bit of time. A lot of my creditors said they would accept the £1 payments for the next 6 months.
    Id definately put down the £150 for food and "hide" the pet insurance. This is an area that worries me- £20 a month in insurance for a 16 year old cat Ive had since she was a kitten. Cant get it any cheaper, plus she had a stroke recently and is on permanant medication. Hoping Ill be allowed it.
  • I hope to get the court fees in next two months so il do what you did and just send them a cheque, i'm used to getting the phone calls and letters so that nothing new.

    I hope you are allowed it, we had 2 cats previousley which my mum got little while before i was born and 1 had to be put to sleep wen i was 13 and sweepy lived until she was about 20, we did all we could for her.
    i was heartbroken when we had to let her go, she was honestly like my sister, she had been there for aslong as i can remember.

    So sad angel - Thankyou for your kind words, but im honestly not brave, ive tried goin bankrupt before but got to scared and dropped out of it.
    but reading other peoples posts and getting really good help and advice from people who have/or going through it, is making it easier to deal with.

  • could I jump in here and ask why does the OR look at your spending over the past two years? Sorry might seem a simple question but I'm think of going br and have run up one or two cards recently!! now I'm getting scared have I done something wrong?

    i think they just look to see if you have recently paid any creditors preferentially before BR or that you havent bought a fancy yacht or something non essential etc..

    They are not there to catch you out just to check...also they will prob check regarding any massive gambling stuff....all in all nothing too bad...after all is said they may impose an BRO or BRU which means some further restrictions but i think these are mainly imposed for buisness types to prevent setting up immeadiately in another name to prevent us as consumers.

    Hi Dodec, hope you are well?

    regarding cat and insurance, i suppose you will have the oppurtunity to defend the expense....give him/her and example of vets bills etc for an older cat which would be much much higher than paying this monthly fee...in a way you are protecting more debts by having the insurance etc...as you would not then be in debt to the vets by being able to pay through insurance.

    If you need any examples of vets bills etc, just give me a PM and i'll try and give you some examples.

    Will i need to find out my loan contracts etc because i dont think i have them anymore.
    What do they class as assets? Will they take my computer off me or my tv or camera (they are all 3years old but bought with my loan money)
    Does any1 know how much you can put down for things such as clothing, holidays, emergencys etc.
