Should I contact Wescot Credit Services?

Hi

I owe £1367.91 from an overdraft I had with Abbey in 2002. This was passed on to Wescot Credit Services. The last letter I had from Wescot demanding the money was in March 2005. Since then I have moved around a lot and they seem to have lost me. Although I am not receiving demand letters anymore I know the debt is there and it is eating on my mind. I would like to get in touch with them to arrange some kind of payment plan but I'm afraid they might be un-reasonable. I'm a full-time student and would only be able to pay back a small amount per month and I fear once they have my new contact details they will demand the amount in full.

Any advice very much appreciated.

    Do not contact them !!! It could be statue barred by now . That is no contact for six years debt time barred . Any debt would have been lodged against you by now so damage ready done .The debt will have increased greatly with interest added and costs. Plus this DCA would not have held onto it for this long , it will have been passed on to another firm by now . Hold fast and if anyone does contact you denie everything ! DO NOT MAKE CONTACT WITH ANY DCA BY PHONE . If you do get any letters come back for further advice . good luck .

    When was the last time that you either made a payment towards, or acknowleged in writing, this 'debt'?
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    In January 2005 I received a letter from 'Nelson Guest & Partners Solicitors' on behalf of Wescot demanding payment in full within 7 days or they would commence legal proceddings. I went the the local CAB who contacted them on my behalf and arranged that I would make a payment of £21 a month for 3 months then it would be reviewed. This was confirmed in the March letter. I payed £21 for the 3 months then left the country for a few years while in the Merchant Navy. Since I have been back I have received nothing from them although I do live at a different address.

    I did order my credit report from Mycallcredit and the debt is not on it.

    Then, unfortunately, this 'debt' is unlikely to be 'statute barred'. As it is for an overdraft, there is little point in requesting a consumer credit agreement as most overdrafts do not fall within the scope of the Consumer Credit Act, 1974.
    However - you should try to ascertain the status of this 'debt' and I, personally, would reccomend that you talk with one of the Debt Counselling Services, or the CAB office with whom you last dealt (they keep all correspondence for six years). If you try to call Wescot yourself, they will try to twist your words to their advantage and may try to get you to agree to a payment which you may not be able to afford.

    Thank you for your replies. The CAB I dealt with in back home in N.Ireland. I am back there soon so will call in and talk to them.

    So I should not contact Wescot then?

    Most definitely not - at least until you have taken the advice of CAB.
