Faulty Mattress Advice Please

Hi all, we bought a new bed from Argos October 2007, came with a standard firm mattress, which the springs went within a month, argos arranged an exchange for a surposed higher quality firm Silent Night mattress and we paid the £45 extra to upgrade to that.

Springs are going in this as well now and we've only had it since late November 07, can i ask for a refund or will have have to exchange again as this is second faulty\poor quality mattress in less than 6 months? thanks

    Who told you that Silentnight were better quality than the first mattress???

    Check your delivery paperwork/receipt - did you buy the bed and the mattress separately or did they come together?
    If you ordered each part separately then it's easier, but if they came together then it may be a bit more difficult.

    How did you exchange it the first time?
    You said you upgraded your mattress. Did they give you a partial refund (ie what you paid subtract the cost of the frame only, then charged you for a new mattress) or did they take the whole bed and mattress, refund it and then sell you a new bed and mattress?

    If you bought a mattress within a year, its a repair or a replacement - straight of?!

    Contact AD to arrange this, bit poor that it broke within the year. AD are pretty good with time scales for replacements, try not to leave you with poor goods for longer than they have to.

    It may be the case that you will get a replacement one, or you can choose to downgrade/upgrade again, however technically they don't have to give you a refund, as firstly the order of customer service faulty items is repair (not applicable here), if no repair available, replacement, or if that's not possible, a refund.
    The Sale of Goods Act also states that your right to a refund depends on the amount of time you have had the item.
    This is not to say Argos Direct won't offer you a refund - ask on the phone for a refund (if that's what you want), not in store though because store staff cannot sort it out as it is an Argos Direct purchase.

    If the mattress is faulty, and it is within the manufacturers guarantee period the it should be replaced. However, find out what the retailers policy is as you would be better off changing to another brand if you want it to last.

    Thanks all for the advice, still deciding on what to do, have turned the mattress and seemed bit better, but starting to get back ache again now.

    We bought the bed and mattress as a set, the mattress that came with the package gave up within a month.

    Rang Argos and they said to go into local store and chose another mattress and pay the difference and they will collect faulty one when new one arrives.

    The difference was £44.99 and on receipt it says we paid cash of £129.99 (presume this is what the original mattress was worth if bought separately) and paid the extra £44.99 via credit card.

    So I presume now when I ring them they will only have details of current mattress as we have a different order number than when we originally ordered with the bed and mattress?

    Can anyone recommend a good firm mattress that Argos sell in case they won’t refund? Thanks
