Can i just ask if all my creditors eventually take me to court for a ccj, how long do i carry on paying it if my circumstances don't change? The rest of my life??

I am afraid you would have to keep paying till the debts are paid off, yes.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

How much would the debts be for?
If they total less than £5,000, you owe at least two creditors, and one has a CCJ then you could apply for an Administration/Composition order:
See: Factsheet | Administration Orders
If there is a risk that the AO would take an excessive time to pay off because of your circumstances, then the court can make a composition order that limits the period over which it can be paid. Anything outstanding at the end would be written off.
There is the "Debt Relief Order" due to be brought in by the "Tribunals, Courts and Enforcement Bill" for debts of less than £15,000 as an alternative to other provisions.
Can't remember if you can include CCJ's in those though.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi Shezzy you need to talk to a debt charity to consider all your options. CCJ's if instructed against you should be at a level you can afford, otherwise you ask for the judgement to be varied.

I had a CCJ which was originally set at paying £250 per month for a Credit Card. i applied for the varying order via newcastle CAB. Had it reduced to £85 pm which helped for a while, but with more expenses is still high..dont think court would reduce again though.
It cost me £30 or £35 to vary the order, i didnt even fill out the forms...my very nice advisor did all the paper work for me..

i'm afraid our debts are unsecured at a total of £53,000 so it looks like we will be paying it off the rest of our lives, have thought of bankruptcy but we don't want to lose our home we would get roughly £10,000 if we sold it, but the kids are settled here and so are we.

Thankyou for all your replies

well theres two ways too look at it pay 85 for rest of your life or bite the bullett and start fresh pay back the or people 85 for 3 years or what ever they set , but after 6 months of br the fresh start and not worrying is good , but weighing up of loosing the house or not is another matter0

Dave - if your circumstances have now changed you can make another application to vary the current order - exactly the same procedure as last time. x xPay Debt by Xmas 16 - 0/12000

Whose name is the debt in? How much is your house worth and how much do you owe on it? If one of you has the bulk of the debt in their name then it may be possible for one of you to go BR and the other one buy the beneficial interest. Bankruptcy doesn't automatically mean you will lose your home. Have you spoken to one of the debt charities? They will be able to advise you of the choices you have and you will feel a lot better once you know what is available to you.i'm afraid our debts are unsecured at a total of £53,000 so it looks like we will be paying it off the rest of our lives, have thought of bankruptcy but we don't want to lose our home we would get roughly £10,000 if we sold it, but the kids are settled here and so are we.
