hi everyone
as you may or not be aware hubby is going BR mid April, and just having a look at the dreaded forms online!!!
In the section where you list unsecured creditors, am i right in saying that we just add all his credit cards and loans and overdraft in here
The confusing part is i have an argos card and pay 12.00 per month so this is easily affordable , its in my name and not hubbys but comes out of the joint bank acc which is severly overdrawn, so i am presuming i dont add this as its in my name and i am not going BR, then when he has gone BR obviously give Argos card a different bank acc details for the DD
Am i right and is this all ok.

I gather that , as I am in same situation , if debt is in your name & is affordable by you, then it is not included in his BR . Get DDR switched to pay from your account.

Glad to see you have started tackling the forms...that was my good friday mission...which i did most of...
if it is only OH going BR then you will only need to list all of his debts and any that may be joint...nothing in your name as it is not your pertition for BR.
Angel is right in saying that you should set up an account for yourself as it is the joint account would be frozen at time of BR by the bank. you may have access to your 'interest' in the account but i would suggest you set up your own to be certain.

The thing is the argos card payment has been coming out of the only acc we have (joint) (severley overdrawn) but the card is in my name and not hubbys
I dont actually "work" but sell things on ebay so am able to pay this DD once hubby gone BR and when i get an acc up and running for myself.
Still surely i dont add this in BR as it is DH going BR and not me, how will this be looked upon by the OR who will have seen this coming out of the acc for past 18months, yet not included in the BR

Also IF my DH has to meet the OR face to face does anyone know if i will be bale to accompany him, its just that sometimes he can be a bit useless with fact and figures

The card is yours not his, so it doesn't get listed on his forms.

do you have any idea, how long the bank will give me to pay the od back, its pretty hefty 9k:eek:
A family member is hopefully helping me out, however if this is not the case, what will they do , would they want full amount, , will bailiffs debt collectors etc etc chase me?0 -

Doesnt matter regarding card, its the account holder who is responsible

Trying to prove 'income' from this may be difficult as not guaranteed

if you have proof to say that the payments are in your name, ie the argos card then thats fine...at the end of it all you have a joint account so the OR will be aware that more than one person is going to use it...i wouldnt worry for this with his BR.

i think you can go to the office and/or court but im afraid that you may not be able to go into the room incase you 'lead' OH towards an answer..it may look bad on your OH if you do as the OR may wonder regarding who is actually at 'fault' so to speak...does that make sense.

They will "want" it all back. But what they will "get" is something else.
It's impossible to tell exactly what they will do, but if they aren't reasonable or pass it to DCAs it's likely to be way more threats than actual action.
Even if the absolute worst happened (which probably won't) and they went to court, then as long as you didn't ignore the court they would tell you to pay in instalments you can afford. It's only when you ignore the court or fail to make payments that there is even the faintest chance of a bailiffs. Even then you don't have to let them in.
There is plenty of help on here and DFW when/if you need it.
