Solicitors request for info

Hi all,
We have a couple of problem debts and have taken the appropriate advice.
Just a quick question:
We have had a £5 / month payment approved for a small debt of £500 (ish) after supplying a personal budget to them as advised. This was agreed with the creditors solicitors and they arranged via a direct debit.
They are now asking for other info, eg what assets we have, equity / value of house. how old the kids are, and a whole host of other 'personal' information and are also saying that they never recieved the budget (even though they accepted the payment based on it and was with the offer we sent ??).
Question is - do we supply all the info they requested or just what we did before as National Debtline / CCCS suggest.

    Hmm why do they want all this personal info? I would send them the budget you sent them before and not send them any more info. Do you owe them this money? they sound like they may be trying it on to be honest- they should have this info if you took out a product with them or bought something with them surely? and if they bought the debt they should also have the details they need. Would not give them any additional info at this stage- what did CCCS and National Debtline advise?

    They may be looking to see what options they have for getting the money back ie threatening bailiffs or threatening to put a charge on your house - that sort of thing. Can't think it's any good though.

    We run a smallholding (a few chickens and a couple of goats, plus home grown veg & fruit) and had some stock feed delivered and the debt is for an invoice received. Due to a change in circumstance we were unable to pay, they have just passed it to their solicitors, who are asking for the info. I don't hink its anything untoward, but would you necessarily give them amunition that they don't need just becuase they ask or would you be up front and give them all your financial details?
    They have threatened ccourt action but we are just paying what we can afford as suggested by National Debtline.

    I agree. Resend the budget, but do it recorded delivery this time so it can't ("conveniently" :rolleyes:) get lost in the post and you have proof they got it.

    The rest of the information they are asking for is none of their business.

    Just keep paying the amount agreed.

  • Thanks thats what I thought ... Just resend recorded delivery what we had already sent a personal budget and copy of the letter. ;)

    Make sure you pay them the agreed amount every month whether they 'accept it' or not. Do you have details of their bank account so you can set up a standing order every month? They could take you to court but this would cost them money. It is important you keep paying as per your budget as if it did get to court and you can prove you are trying to pay and you really are struggling - the judge is likely to take your side. They can't take money you don't have - the court has to allow you money to live on - they can't make you get more in debt so don't be afraid if they do go down that route - it will be a pain and a bit of hassle but don't be scared - it is not like you are trying to hide from the fact you owe money so just stick with it.

  • Thanks Dancingfairy, that's what we thought.
    We don't have their actual bank details only the direct debit in place. It is however only in a bank acount thats got very little money in so they can't take too much anyway ;)
