I made the call! Now for the questions!

I finally plucked up the courage to call National Debtline this afternoon and they could not have been nicer!

They did a budget form and it was as we thought - £0 surplus!

They have advised OH does go br and suggested I do too but I really want to try and save my business so am going to hold off for a while.

So, OH is going for it asap. How many years worth of bank statements will he need?

Will they want joint account statements even if we close the account?

Have no credit etc....ideas on how to raise br fees?

Should I talk to Housing Assoc about our tenancy? We are joint tenants so could we lose the tenancy?

Am off to register on Insolvency website to download the forms...

How does financial linking work? Will I be affected by his br?

Sorry for the bombardment! I feel relieved that I made the call and have made the big decision, now terrified of what is to come!

Lastly, OH is french and although he speaks English he doesn't cope well with 'fancy legal language'.....can I accompany him for his time in court and the or interview? He will really struggle with a telephone interview.

    Well done on taking the first steps to getting your life back.

    The OR will ask for how ever much he needs statement wise. It could be 1 years worth or it could be 5 years. Anything you haven't got then they can get so don't panic.

    I am assuming you are maxed out on all your cards, so no money there. Any room on your O/D for the fee's? Could you open a credit union account in your name and put aside £10-15 per week. After 10 weeks you can borrow 3 times your balance. You then carry on paying the same in and some goes to your savings and some to your loan. Google credit union and your town/county. Any local charities that might help out? Anything you can sell, carboot, ebay, paper? You may be able to get remission on court fees. brb with link.

    We are with a HA and there has been quite a few posters in the same situation and the answer has always been as long as you are up to date with the rent then they are not bothered. An anonymous call to them will confirm it though.

    If you try and get credit and have any joint loans or bills etc then you could be refused as he is BR.

    You will be able to accompany him to court to help him but you will not be allowed to speak for him in the judges chambers. But the judge will only ask simple questions like have you taken professional advice and are you aware of the consequences. The OR may be trickier but if you explain about things then he might be able to hand you the phone if he gets stuck. I am sure someone will tell you if you can help him or not soon. As I am not 100% on this.

    Keep asking any questions you need to.

    Making the first step is and was the hardest for me. i have been trying to pay for my ex girlfriends mistakes for the past year with help from the CAB but things have prgressively gotten worse so i think BR is gonna be my best option as i have debts of around £140,000 inc joint morg and 2nd loan of £81,000.

    i have filled out the online cccs form and as expected i was advised bankruptcy. i have received a ref no. to contact them tm to discuss exact options for me so will update as i go along. This site has been fantastic over past couple of days getting some really good advice, Thanks Fermi for all advice you have given so far....im sure i'll be back for some more after phone call tm.

    Again, Well Done and Good luck Scared1970..everything will work out fine in the end and im sure people here will be available for moral support and as much help as needed.

    thank you scared1970, im sure you will be just fine and get all the advice you need. i have found from talking to people on here that there is hope and that really no need to worry as there is always a solution to every problem.

    Good luck and keep us informed. i will do the same on my thread with updates after my conversations with CCCS and IP tm.
