Littlewoods paid me too much back

Options
Littlewoods owed me money for non delivered goods. This had been on going since September 04, after many letters back and forth I was eventually paid everything back in dribs and drabs.
Then I started to get letters telling me I owed them money, I ignored these at first thinking they were in error, but when I eventually got to the bottom of it, again after many letters it transpired they had paid me back for one of the undelivered items twice.
I was not aware of this as it had been my sisters card that was used to purchase the items and the refunds were applied to there as well. When she checked through the statments it was right enough they had refunded twice. They want their money back which is fair enough, but I can't afford to pay it all in one go and I am getting letters threatening court action and interest and admin charges have now been added on.
I would appreciate any advice on how I can get them to take a monthly amount I can afford without them adding extra costs onto it.
There is nothing either good or bad but thinking makes it so.

If they've overpaid you by mistake, I think it's probably their tuff luck.

I don't think they are entitled to chase you for the money.

How much was it for anyway?

They are entitled to chase you for the money, however give them a ring and explain the situation. You should be able sort out some way to pay it off over several payments and would hopefully get the admin fees waived.
  • If this has gone onto your sisters credit card shouldn't your sister be phoning them up with the card details for them to debit the money back

i agree i dont think it is legal for you to be authorising a charge against some one elses card.

personally i would give tell them you will pay it back in instalments. if they complain, say well its your fault and itson someone elses card... so there  although i dont expect this to work...... :D

I was repaid money by Currys twice and when I accepted that they had paid me twice I wrote back to them and charged them £50 for the time it had taken me to sort out the problem. I deducted that sum from the cheque that I sent them and stated that the amount I was paying was a full and final settlement. I received a letter back as a receipt accepting what I had paid as full and final settlement.

I agree with Robnye, Make them an offer of what ever you can afford to pay back each week. If they refuse and take you to court, you can use this in your defence. I believe the Judge would throw it out of court.

Thanks for all the advise, i did wonder about charging them for the messing about, but thought they had to agree to my T and C's before that was possible. The amount they want is £59

  • I don't think I will say any more on this subject as I'm sure the swear words would get me banned by the moderators.

  • What i cannot understand here is why your sister has not paid back the money that was credited to her account by mistake??? Why are you having to pay it when she has received it? It just does not make sense and nor can i see how they have messed you about. Sorry if this sounds harsh its not meant to but i think your sister has some responsibillity here
