Please help - been stupid!

We bought a house last year and we paid 2% commission to the mortgage broker however we had to use their approved life assurance and income protection provider, however they were approx 50% more expensive than we could get through the bank so we cancelled with them. The mortgage broker then wrote to me a few times asking for the 1% and I stupidly ignored them then last week I received a letter saying I owed them even more because there was a mistake with the commission. Anyway to cut a long story short they have today sent me a claim form from the courts - does this mean I will get a CCJ against me?

    Firstly, you can apply online for an extension to sort it out. It will be listed as one of the actions you can take and will extend the deadline to admit & pay/admit & dispute.... from 14 to 28 days. The main thing is to do nothing because then a CCJ will be lodged against you.

    Depending on amounts (is it payable? did you withold payment out of hardship? or chagrin?) and your fiscal circumstances, you should then take the next appropriate step; the form allows for all eventualities including a statement of your means for you to arrange a payment schedule.

    Tbh we just cannot afford to pay the amount in full. If I admit the claim would a CCJ still be entered against me?

    Shouldn't be (but don't take my word for it 100%) - IF you follow their procedures.
    Asking for a payment schedule is the best thing to do - but it does mean that you will be required to complete the income/expenses form that is part of the response pack. I understand that you return this to the Court that issues it and they liaise with your Creditor.
    This my advice but I honestly don't know what they do when you request time to pay/small payments. I was waaaay more stupid than you and actually have a CCJ (or two?) and am going BR tomorrow. Trust me, I wish someone had told me what I should do.......

    Lol, I assumed that was what you meant.

    Feel better about this already, thanks guys. Just want to try and find out if it will mean a CCJ now:confused:
