Help! does anyone know if my Manager is right

    Hi Misty :D

    You can only return if your GP signs you fit for work again.

    Your manager (I presume) is not a Dr and cannot make the decision to whether you are fit for work or not :rolleyes: In fact, even if they are a Dr you dont have to be a physical jibbering wreck to be sufering from Stress.

    I'm actually appalled at your managers treatment of you and HR's lack of input. I would be tempted to make this an official grievence.

    So sorry to hear about this.

    Please go and join your union at work. Officially they are supposed not to help for a certain number of qualifying weeks, but I have heard of people signing a union membership form and getting help the same day.

    This IS bullying. You don't deserve it. Take good care of yourself xxx

    Just had to google to say what your hubbies illness is - ah Chronic Obstructive Pulmonary Disease (to do with lungs) - ah, now enlightened on that front.....

    Just to say "good luck" and basically echo what others have said:

    - join the Union
    - you cant be told to return to work when you have a sick note (its against health and safety and would create problems for the employer with their insurance cover)
    - get things in writing
    - always have a witness in meetings
    - keep a diary of events (Mr X said this on that date, at such and such a time, etc).

    Just a sideline thought - wondering whether you could contact your phone supplier and say you are receiving nuisance phonecalls (dont need to say its your employer hassling you) and ask for an urgent change of phonenumber and make it an ex-directory one this time. Then they cant phone you. Employers can always contact their staff if need be by sending a letter or dropping a letter through letterbox - they cant require an employee to have a phone (one cant make an employee pay for phoneline rental). You just tell them you are economising and have had to cut out having a homephone - and your mobile phone number (well you dont have a mobile - or they cant have that, as a mobile is a personal possession).

    They might be awkward about it - but an employer cannot actually insist on having an employees phone number. An address is sufficient contact details - and letters have the added advantage that you have proof in writing of what they are saying to you.

    Definite bullying and that's not acceptable in todays workplace. Stay away from work until your GP says otherwise.

    I would go back on 1st April..

    My manager has now decided I can use my annual leave straight after my sick leave after all:confused:

    Thanks for your advice which makes me more determined to sort this out...my husband thought I would cave in and just go back as I am not a fighter by nature and have never stood up for myself... he thinks I need to harden up against these people in life.

    Your support and input is greatly appreciate. Yes I think I should look into a grievance procedure..as I feel bullied and harrassed. DO I MENTION THIS TO THE OCC HEALTH DOC TOMORROW??

    My GP was not there today when I rang at 8am I have to ring in the morning hopefully for an early appointment to see him urgently before I see Occ Health at 11.45am.

    I am so glad to hear that you can now use your annual leave now. Nowt so strange as folk eh. I think my problem is dotchas, that I dont make enough of a fuss, just do things to keep people off my back. Like I said my husband thinks I will just go back without a fight...but I must fight this...otherwise I could get back in the workplace and be back at square one again..and I dont want them seeing me bursting into tears.
    And I have done reading & geography.. too ! ;)

    The funny thing is, I thought that I had caved in over my annual leave as I went and got signed off instead (OH have said to go back to work 1st April)

    So I have no idea why they have come to that decision now.

    Still I am not complaining.

    I think if I was you I would tell OH that this incident has stressed you even more and made the situation worse.
    DO tell OH (and GP) all the problems you are having,sleeping,stress,worrying and so on.Write them down tonight if you think that might help.I know my brain turns to mush in these situations.

    I think that is what happened to my brain yesterday dotchas, it turned to mush and i was nodding like a nodding dog in the back of a car...eek
