in Cutting tax
Hi,
My dad is a pensioner, last year he was exempted to pay council Tax.
In Feb 08 I moved back to my parents house. I know as in paid employment I have to pay a some toward my dad's council tax.
I earn £16909 a year. Any idea with this income, how much council can ask me to pay? I live in Birmingham and my housing band is B.
Thanks
MS

Hi there,
I think that as your dad is exempted council tax (can you say why this is?) then you will not have to pay any of his council tax (he's exempt so is invisible for council tax purposes), but you will have to pay yours. As you will be the only liable party in the house you will pay the full whack minus 25% single person discount (because your dad is exempt).
Also as you moved back to live with him in Feb the Revenues Dept of the council will also be after you for money from when you moved in to the end of the tax year.
Hope this helps0 -
Why was your dad exempt ?.
If he had an exemption on the property then this will end unless you are also disregarded in some way for council tax purpose and your dad will become liable for any council tax owing (likely to be 75% of the full charge) as he is the resident owner/tenant/leaseholder (under the hierarchy of liability)I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
In deed it is the property which is exempt not the person once you move back in the property will no longer be exempt, and as the owner your father will be responsible there may be some discount available due to your father being non-countable towards CT, sounds like it will be 75% of the tax on the property.0

Thanks for your replies.
The reason my parents were exempted to pay CT for period 07-08 because they had over 2k debt from previous yeras. They did not apply for Council Tax Benefits so they had to pay for the previous yeras.
I have searches on yahoo and found this http://www.eastrenfrewshire.gov.uk/benefits_5-2.pdf
I come under non independed for Council Tax Benefits. It is showing as:-
Income between Deduction taken
£164 - £282.99 £4.60
£283 - £352.99 £5.80
£353 or more £6.95
I get around 350 gross a week/ The deductions will be £5.80. Can anyone explain how this would work?
Thanks

Debt would not remove any liability to Council Tax - Council Tax for each year will become due regardless therefore if they haven't yet paid for 07/08 it will need to be paid.
If there are two occupants in a property already who are not disregarded for council tax then a full charge is due and extra residents will not affect the charge. It sounds like it will make no diference if you move in.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals.
