Tax Position leaving Uk

Options
Hi

I have been working for a UK company in Australia for the whole of the 07/08 tax year so am not resident in the UK for this period.

However, I have been paid out of the UK, and thus subject to NIC and Income Tax, for the whole of the period.

As from March 08 I have now been transferred to Australia, on an Australian contract.

Technically I should not have been taxed in the UK as I was not an ordinary resident.

However, this may open up a can of worms with the Australian authoriries as no PAYG tax has been paid on my behalf there.

Do you think I can claim backmy NIC/ Income Tax for this period?

I dont see how claiming a refund of UK tax will affect your Australian tax as HMRC will not tell Australia anything about you.
Did you complete a form P85 when you left the UK? If not, you should do this now and send your P45 in to your tax office when you receive it. You will need to wait for your refund now, once your P60 is available.

Evading tax in Australia would be foolish. You will need to declare your income on your tax returns to 30 June 2007 and 30 June 2008
