I have moved should I tell DCA

I was just wondering what the opinion out there was.

I have just moved house and am being chased by Robinson Way for a debt which they have failed to provide a CCA for.

I requested a CCA in November and they still have not supplied it but are still sending me letters every month asking for money.

Would you just not tell them you had moved or not?

    It is complicated.

    I had paid them from March 2004 til Nov 2007 as I was unaware of my legal rights. Since I have put it into dispute they have been unable to provide me with the requested CCA and are therefore acting illegally by still chasing me.

    I have reported them to Trading Standards and have a form ready to send back giving my permission to use my name if they want to make a case against the company.

    no as you have made payments then you have admitted to the debt so you should tell them of the change

    as they have failed to respond to the CCA. It is they that are committing an offence. Don't tell them. they will soon find you if they want you. However make sure you tell TS

    Just looking for any further opinions. I appear to have 1 yes and 1 no at the moment so am still unsure as to what to do.

    You can choose to dispute a debt at any time even if you've been paying them. They are the party committing an offence.

    IMO definitely don't bother to tell them.

    Have you got mail forwarding set up from your old address?

    If not and the idiots are stupid enough to try court, then they could end up obtaining a judgement "by default" as you wouldn't have been able to respond to any claim form.

    You might stand a chance of getting it set aside, but it would be a major pain.

    Previous to March 2004, when was the last payment and correspondence made to the DCA by yourself? If there was a 6 year lapse before this i.e. if it was March 1998 or before that you made your last 'admission' of the debt then it would be statute barred and even if you did make a payment after that 6 year time period it would not hold you responsible anymore, you would be able to stop paying at anytime and they wouldn't have a leg to stand on.

    If the last time you wrote to them or made a payment previous to March 2004 was after 1998 then you are still liable and they will make an effort to find you anyway. How much is the debt if you don't mind me asking?

    The debt is in my previous married name so I cannot have it set up on redirection as this is the only correspondance which ever uses that name - they will not change it I have asked before.

    So if all my mail is redirected then theirs will not be.

    Prior to 2004 debt was paid when we (myself and prev OH ) used a debt management company to help us. We delt with this company from Sept 1998 to Sept 1999 as we couldn't afford to pay for their service any longer. (at the time we were unaware of any free help available)

    When we took over paying our debts ourselves this one was forgotten about and I didn't hear from them until 2004 by which time there was a huge amount of interest added to the initial debt. I started paying it as I was unaware I could query it or ask for proof I just assumed that as it had my name on it I owed it.

    I have since put the debt in dispute and asked for a copy of my CCA in Nov 2007 and up until now they have not supplied it.

    The total amount outstanding is £1408 I have paid £1070 from March 04 to Nov 07. From what I can remember it was no more than £800 back in 1998.

    From birth to 2001 we lived in Scotland and from then until present day we live in England.
